Woodstock Provincial Court: Centreville man with meth addiction gets prison sentence for break ins

Centreville man sentenced to 40 months

Brandon Jay Smith, 27, of Centreville, was sentenced to 40 months in jail, minus time served, when he appeared in provincial court in custody by video on Jan. 15

Smith was remanded to jail following a bail hearing last April. He has two years to serve in federal prison once his remand time is applied.

Smith pleaded guilty to breaking into a dwelling house and theft on July 3, 2023, in Summerfield, and guilty to breaking into a dwelling house and garage, as well as theft of several firearms, a boat trailer, and a snowmobile during an incident on March 18, 2024, on the Back Greenfield Road.  One other charge was withdrawn.

Judge Scott Brittain also ordered Smith to register with the federal DNA database and prohibited him from firearms for life. He must also seek counselling and treatment for substance abuse.

The court heard Smith struggles with meth addiction which led him on a drug-fuelled crime spree. He was wearing an electronic monitoring device on his ankle at the time of the offences. Smith had a prior criminal record.

“I know what I did is wrong and I do regret it,” Smith told the court before hearing his sentence.

Judge Brittain told the court Smith had violated the sanctity of a private residence in a rural area while an elderly couple was away on vacation.

During the break-in, he emptied a gun cabinet in the home and then stole $10,000 worth of items from the garage. None of the stolen goods were recovered during the RCMP investigation.

Wotstak man wanted on Canada-wide warrant

Fredericton Police Force is requesting the public’s assistance locating Jesse Logue, 32 years old, who is unlawfully at large and wanted on a Canada-wide warrant.

Logue is originally from Wotstak First Nation. Police believe that he may be in the Fredericton region.

Logue is described as 5’10” tall, weighs approximately 156 lbs, has brown hair and brown eyes.

Warrants issued for Neqotkuk man

The court has issued three arrest warrants for 42-year-old Robin Nicholas of Neqotkuk (Tobique First Nation).

RCMP reported Nicholas is wanted for multiple counts of assault on a peace officer and resisting arrest in connection with an ongoing investigation in the First Nations community. 

On Jan. 16, more charges of unlawful entry into a dwelling house, break and enter and breach of probation were laid in provincial court. Judge Henrik Tonning issued a third warrant at that time.

Davenport awaiting federal prison

Timothy Grant Davenport, 46, of no fixed address, appeared in provincial court in custody by video on Jan. 17 for sentencing after changing his plea to guilty on six charges laid by RCMP.

After hearing final submissions from both crown and defence counsel, Judge Karen Lee reserved her decision on sentence until Feb. 4 at 1:30 p.m.

Crown Prosecutor Cathleen Trafton told the court that Davenport deserved four years and three months in prison, minus time served, and 18 months of probation. She also recommended that he register with the federal DNA database and be prohibited from firearms for life.

Defence Counsel Alex Carleton requested a sentence of three years and 10 months, minus time served. Once his remand time is applied, Davenport will have roughly two years left to serve in a federal institution.

Davenport was charged by RCMP with theft of a gun and ammunition, committing mischief by breaking a window, resisting arrest, possession of a prohibited weapon (a loaded sawed-off shotgun), reckless discharge of a firearm, pointing a gun at another man, possession of a firearm without a licence, possession of ammunition while prohibited, and possession of a firearm while prohibited, in connection with a home invasion on Nov. 26, 2023, near Lakeville.

The crown withdrew three charges, and one firearm charge was reduced to a lesser included offence.

The court heard Davenport entered a private residence in Lakeville where he stole a gun and ammunition and then went into the woods and discharged the firearm. A two-hour police search followed with assistance from a police dog. He was arrested near the store in Lakeville but left the gun in the woods.

The court heard Davenport struggled with mental health issues and substance abuse. He told the court he planned to return to Alberta after his release.

He appeared in court for a bail hearing on Nov. 29, 2023, and was remanded to jail. He has a lengthy prior criminal record.

On Jan. 17, Davenport also pleaded guilty to fraud for an incident on June 17, 2014, in Perth-Andover. The court heard that Davenport deposited empty envelopes into a banking machine at the Bank of Montreal and then withdrew $1,000 from the machine during two separate transactions.

In custody on 20 charges

Yves Levesque, 36, of Plaster Rock, appeared in provincial court in custody by video on Jan. 16 for plea on 20 charges laid by RCMP. The matter was adjourned until Feb. 7 at 9:30 a.m. at the request of his defence counsel.

Levesque waived his bail until later. He was charged with assaulting a female victim on Aug. 14, 2024, at New Denmark and two counts of assault on the same female between Oct. 1 and Oct. 27, 2024, at McLaughlin, Victoria County. He’s also charged with driving while prohibited, uttering threats, assault and assault by choking on Oct. 28, 2024, at Perth-Andover, and uttering threats, assault and assault by choking on Oct. 31, 2024, at McLaughlin.

Other charges include uttering threats, assault with a weapon (a helmet), assault causing bodily harm, breaking and entering a dwelling house, and mischief causing property damage on Dec. 20, 2024, at McLaughlin; breaking and entering and theft, and mischief causing property damage at a shed on Dec. 21, 2024, at McLaughlin; and theft of prescription medication and a cell phone on Dec. 21, 2024, at McLaughlin.

Bail hearing adjourned

Brycen Trae Stewart, 28, of Lakeville, appeared in provincial court in custody by video on Jan. 16 for a bail hearing after being arrested on warrants. His bail hearing was adjourned until Jan. 22 at 9:30 a.m. at the request of his defence counsel.

Woodstock Police charged Stewart with dangerous driving, fleeing police, and breaching his curfew on Dec. 16, 2024, in Woodstock. He was also charged with breaching a no-contact order on Jan. 13.

A warrant was issued for Stewart’s arrest after he failed to appear in court to answer charges on Dec. 10, 2024. He also failed to appear in court on Oct. 30, 2024, and an arrest warrant was issued at that time.

He was charged with two counts of breaching his release order (curfew) concerning incidents on Sept. 24 and Oct. 8, 2024, in Woodstock. He appeared in court in custody via teleconference on Oct. 22, 2024, and was released with conditions.

He was also charged with breaking into a dwelling house on May 25, 2024, in Killoween and possessing a stolen vehicle on Aug. 4, 2023, in Lakeville. He is still awaiting plea on those charges as well.

Kirkland man awaits sentencing

Hilton Romeo Fredericks, 26, of Kirkland, appeared in provincial court in custody by video on Jan. 15 and changed his plea to guilty on charges laid by Woodstock Police. His sentencing date was set for Feb. 24 at 1:30 p.m.

Fredericks has been in jail in Saint John for the past several months following remand for aggravated assault on a minor in Fredericton. His trial is set for March on that matter.

On Jan. 15, Fredericks pleaded guilty to assaulting a female victim between Jan. 14 and Jan. 22, 2024, in Woodstock. The crown withdrew a second assault charge.

He also pleaded guilty to breaching an undertaking by violating a no-contact order on Jan. 23, 2024, and breaching a release order (no-contact) on April 6, 2024, in Woodstock. The crown withdrew another breach charge on April 13, 2024.

Fredericks agreed to sign a 12-month peace bond related to a charge of assaulting another man on April 2, 2024, in Woodstock. The peace bond will result in the charge being withdrawn.

Fredericks appeared in provincial court in custody by video on May 7, 2024, and was released with conditions, including house arrest and wearing an electronic monitoring device attached to his ankle. He was later arrested in Fredericton.

Not guilty on two charges

Gabriel John Tomah, 21, of Neqotkuk (Tobique First Nation), was scheduled to appear in provincial court on Jan. 15 for a verdict following his trial on two charges laid by RCMP. Judge Sebastian Michaud found him not guilty on both counts.

Tomah was charged with assault involving a female victim and uttering threats in connection with an incident on Oct. 1, 2023, at Neqotkuk. He pleaded not guilty. Testimony at the trial continued throughout the day on Dec. 18, 2024. Defence Counsel was Lindsay Paul.

Decision reserved in sexual assault

Maurice Joseph Rossignol, 68, of Woodstock, appeared in provincial court on Jan. 15 for closing arguments following his trial for sexual assault. Judge Sebastian Michaud reserved his decision on sentence until March 12 at 10 a.m.

Rossignol appeared for trial in provincial court on Oct. 23, 2024, after pleading not guilty to sexual assault. Woodstock Police charged him in connection with an incident on Aug. 30, 2023, in Woodstock.

During the trial, the court heard Rossignol allegedly grabbed a woman by the breast and genitals when he came to her apartment to request repayment of a $45 loan.

 Rossignol denied the allegations and testified he left immediately after she refused to pay him. The woman told the court she screamed when he grabbed her and then kicked him out.

Sentencing set on two charges

Edward Hayes Jr., 29, of Benton, appeared for sentencing in provincial court in custody on Jan. 17 after pleading guilty to two charges. The sentencing was adjourned to set a new date on Jan. 30 at 9:30 a.m.

Hayes pleaded guilty to flight from police and breach of probation, shoplifting at the Superstore in Grand Falls on May 24, 2023, and breach of probation on March 14, 2023, in Grand Falls.

On Jan. 17, Hayes stood trial on an assault charge laid by RCMP in connection with an incident on June 17, 2024, in Centreville. Judge Karen Lee found him not guilty.

The court heard a woman was hit by a door when she came to Hayes’ residence to intervene in a domestic dispute. Judge Lee ruled there was insufficient evidence to prove Hayes’ actions were intentional. He testified he stumbled and fell against the door during a scuffle with his partner and then moved away from the door when he knew the other woman was hurt.

Hayes also appeared in custody by video on Oct. 3, 2024, and pleaded not guilty to several charges laid by RCMP. His trial dates were set for Jan. 30 and Feb. 6 at 9:30 a.m.

Hayes was denied bail. He was charged with refusing a breathalyzer demand, resisting arrest, assaulting two police officers, dangerous driving causing bodily harm, assault on a female victim, mischief causing property damage to a vehicle, and driving while prohibited in connection with an incident on Aug. 27, 2024, at Centreville.

Plea adjourned to new date

Clay Hargrove, 30, of Beechwood, appeared in provincial court in custody by video on Jan. 16 for plea on charges laid by RCMP. The matter was adjourned until Feb. 7 at 9:30 a.m. to allow him more time to consult legal counsel.

Hargrove appeared in court in custody for a bail hearing on Dec. 17, 2024, and waived his bail until later. RCMP charged him with possession of a stolen vehicle, flight from police, driving while prohibited and driving while suspended following an incident on Dec. 8, 2024, at Tobique Narrows.

He was also charged with breaking into a cabin, theft, and mischief causing property damage to a door in relation to a separate incident.  More charges of aggravated assault involving a male victim and possession of a stolen motorcycle were also laid for an incident on Aug. 27, 2024, at Upper Kent.

Sentencing delayed

Zachary Sarchfield, 30, of Wotstak (Woodstock First Nation), will appear in provincial court in custody by video for sentencing on Feb. 18 at 9:30 a.m. after pleading guilty to two charges laid by RCMP. He was scheduled to appear in court for sentencing on Jan. 14 when the matter was adjourned to the new date.

Sarchfield was charged with breaching his release order by violating electronic monitoring and committing mischief, causing property damage to an ankle bracelet for an incident on Sept. 6, 2024, at Mainstream.

He was also scheduled to enter a plea on other charges in Fredericton for possession of stolen property and dangerous driving causing bodily harm. He was remanded on those charges.

Sarchfield also has a trial set for June 30 at 9:30 a.m. after pleading not guilty to other separate charges.

Sarchfield was charged with attempting to breach his release order in July 2024, as well as two counts of unlawful confinement, assault, and possession of a weapon for the purpose of committing an offence concerning another incident on Sept. 11, 2023, in Woodstock. He pleaded not guilty. He was also charged with failing to appear in court on Feb. 20, 2024, when an arrest warrant was issued.

Charged with sexual assault

Christopher Thomas O’Keefe, 27, of Fredericton, formerly of Fielding, appeared in provincial court on Jan. 15 to answer a sex charge. He pleaded not guilty, and his trial date was set for Dec. 18-19 at 9:30 a.m.

O’Keefe was charged by RCMP with sexual assault in connection with an incident on Feb. 26, 2023, at Upper Brighton. A monitoring date was also set for March 11 at 9:30 a.m.

Arrest warrant issued

The court issued an arrest warrant for Chandler Spittle, 22, of Perth-Andover, after he failed to appear in provincial court on Jan. 17 for plea on two charges related to counterfeit money.

RCMP charged Spittle with possessing counterfeit money (a $100 US bill) and using counterfeit money concerning an incident on Dec. 24, 2023, at Johnson Settlement.

Charges to be transferred

Patrick Myers, 39, of Fredericton, appeared in provincial court in custody by video on Jan. 16 for plea on three charges laid by RCMP.

Myers was charged with possession of a stolen vehicle, breach of an undertaking and possession of ammunition while prohibited in connection with an incident on May 20, 2024, at Plaster Rock.

Myers asked the court to transfer the charges to Fredericton, where he is awaiting sentencing on other matters on Jan. 21. A monitoring date was set for April 17 at 9:30 a.m. to confirm the transfer has taken place.

New Demark man facing charges

Damian Pelletier, 30, of New Denmark, will appear in provincial court on Feb. 11 at 9:30 a.m. for plea on two charges laid by RCMP.

Pelletier was charged with driving while impaired by drugs and mischief causing property damage for an incident on June 30, 2022, in Waterville. He made his first court appearance on Jan. 14, when the matter was adjourned to the new date.

Assault charge laid

Abdulmajid Alghlid, 59, of Woodstock, will appear in provincial court on Jan. 28 at 9:30 a.m. to set a date for his trial on an assault charge.

Woodstock Police charged Alghlid concerning an incident in Woodstock on May 27, 2024. He entered his not-guilty plea at a court appearance on Jan. 14.

Returning for plea

Brock Perley of Neqotkuk (Tobique First Nation) will appear in provincial court on Feb. 11 at 9:30 a.m. for plea on two charges laid by RCMP.

Perley was charged with uttering threats and assault following an incident on Aug. 2, 2023, in Lower Knoxford. He was scheduled to appear in court on Jan. 14 when the matter was adjourned to the new date.

Facing two charges

Willard O’Donnell, 51, of Napodogan, will appear in provincial court on Feb. 4 at 9:30 a.m. for plea on two charges laid by RCMP.

O’Donnell was charged with assault with a weapon and failing to stop at the scene of an accident in connection with an incident on Jan. 18, 2024, in Florenceville-Bristol. He appeared in provincial court on Jan. 7 when the matter was adjourned to the new date at the request of his defence counsel.
