Woodstock Provincial Court: Perth-Andover woman to be sentenced for forgery

Perth-Andover woman to be sentenced

Faith York, 23, of Perth-Andover, will appear for sentencing in provincial court on June 18 at 1:30 p.m. after pleading guilty to a forgery charge.

RCMP charged York with uttering forged documents (cheques) and defrauding a bank of $5,747 concerning incidents at Neqotkuk (Tobique First Nation) between June 13, 2022, and July 4, 2022.

She pleaded guilty to uttering forged documents, and the crown withdrew the fraud charge.

Change of plea on five charges

Megan Elizabeth Lewis, 30, of no fixed address, appeared in provincial court on June 12 and changed her plea to guilty on five charges laid by Woodstock Police. She returns to court for sentencing on June 28 at 1:30 p.m.

Lewis was charged with unlawful entry at a dwelling house, assaulting another woman, committing mischief causing property damage to a door, two counts of assaulting a police officer, and breach of probation for an incident on Dec. 28, 2023, in Woodstock. The crown withdrew the charge of unlawful entry.

Lewis appeared in provincial court in custody by video on May 21 for a bail hearing. She was released with conditions to a rehab facility in Shediac but left the facility in breach of her release order.

Judge Sebastian Michaud warned Lewis she had violated a court order by leaving rehab. Lewis said she did not want to return and was now living in a tent in Woodstock. He ordered her to report to the police weekly until her sentencing hearing.

Lewis spent several months in custody prior to being sent to rehab. The court heard a joint recommendation of time served, and probation will be made at her sentencing hearing by both the crown and defence.

Warrant issued for Neqotkuk woman

The court issued an arrest warrant for Leah Driscoll, 43, of Neqotkuk (Tobique First Nation), after she failed to appear in provincial court for plea on June 12.

Driscoll appeared in custody by video on May 29 for a bail hearing on charges laid by the RCMP. She was released with conditions and ordered to return to court for a plea.

Driscoll was arrested and charged with breaching a release order on May 27 and resisting arrest on April 29. 

She also appeared in provincial court on Dec. 19, 2023, and pleaded not guilty to three other charges laid by RCMP. A trial date was set for Oct. 31 at 9:30 a.m.

Driscoll was charged with obstructing a police officer and two counts of willfully neglecting an animal (two dogs) concerning an incident on July 23, 2023, at Neqotkuk.

Trial adjourned on impaired driving charge

Chatawna Nicholas, 49, of Neqotkuk (Tobique First Nation), appeared for trial in provincial court on June 14 on an impaired driving charge. The trial was adjourned until June 20, 2025, at 9:30 a.m. at the request of her defence counsel.

Nicholas was charged by the RCMP in connection with an incident that occurred on March 19, 2023, at Neqotkuk. She pleaded not guilty.

Charges withdrawn

Austin Francis, 25, of Neqotkuk (Tobique First Nation), appeared for trial in provincial court on June 13 after pleading not guilty to two charges laid by the RCMP. The crown withdrew the charges, and the trial was cancelled.

Francis was charged with assault involving a female victim and assault with a weapon (a metal bar) concerning an incident on Feb. 23 at Neqotkuk. He entered his not-guilty plea on Aug. 15, 2023.

Perth-Andover man released on undertaking

Joseph Martin, 37, of Perth-Andover, appeared in provincial court in custody on June 12. He was released on an undertaking and returns to court for plea on July 2 at 9:30 a.m.

RCMP charged Martin with possession of a stolen ATV and breach of probation. He failed to appear in court to answer the charges on June 4, and a warrant was issued. Martin turned himself in at the courthouse on June 12 and was arrested by sheriffs.

Woodstock man in custody

Braxton Denny, 24, of Woodstock, appeared in provincial court in custody on June 12 and was remanded. He returns to court in custody for a bail hearing on June 17 at 9:30 a.m.

Woodstock Police charged Denny with breaching a release order by failing to abstain from drugs between June 6 and June 7 in Woodstock.

He also appeared in provincial court on Jan. 16 to answer other charges for alleged events. He pleaded not guilty on all counts.

Denny was charged with possession of stolen property on July 23, 2023; flight from police on July 22, 2023; and two counts of failing to appear in court on Oct. 17 and 24, 2023. A trial date was set for Dec. 11 at 9:30 a.m.

Denny appeared in provincial court in custody for a bail hearing in December and was released with conditions, including wearing an electronic monitoring device attached to his ankle. He was arrested on a warrant and charged with breach of a release order.

He was also charged with breaking into a dwelling house and committing mischief in connection with an incident on Feb. 18, 2023, in Woodstock; committing mischief causing property damage and breach of an undertaking on Dec. 9, 2022, at Upper Woodstock; and two counts of assault and committing mischief causing property damage on Dec. 8, 2022, at Upper Woodstock. A trial date was set for Oct. 21 at 9:30 a.m.

Back in custody on new charges

Kyrin Moulton, 18, of Grand Falls, formerly of Neqotkuk, appeared in provincial court in custody by video on June 12 on new charges laid by RCMP. He was remanded for a bail hearing on June 17 at 1:30 p.m.

Moulton was charged with breach of probation and two counts of breaching a release order for incidents on June 10 at Perth-Andover and Neqotkuk.

Moulton appeared in court in custody by video on May 30 for a bail hearing and was released with conditions. He was ordered to return to court for plea on June 25 at 1:30 p.m.

RCMP charged Moulton with assault involving a female victim, breach of probation, and breach of a release order stemming from an incident between April 14 and April 25 in Perth-Andover.

Bail hearing rescheduled

Kelsey Janetta Brooker, 30, of Florenceville-Bristol, appeared in provincial court in custody by video on June 13 for a bail hearing. The hearing was adjourned until June 20 at 1:30 p.m. at the request of her defence counsel.

Brooker appeared in provincial court in custody by video on June 11 and pleaded not guilty to one charge laid by the RCMP. Her trial date will be set at her next court appearance. The RCMP charged her with being at large on a release order for an incident on May 30 at Perth-Andover.

The court heard a conditional sentence order was revoked following her arrest, and she was held in custody. Brooker has a prior criminal record.

Regis Bowmaster, 30, of Bairdsville, also appeared in court in custody on May 30 for a bail hearing. He was released with conditions and returns to court for plea on June 25 at 1:30 p.m. He was arrested on a warrant and charged with breaching a release order by failing to appear in court on Feb. 13.

Arrested on a warrant

Zachary Sarchfield of Hartland will appear in provincial court in custody by video on June 20 at 9:30 a.m. for a bail hearing after being arrested on a warrant.

RCMP charged Sarchfield with two counts of unlawful confinement, assault, and possession of a weapon to commit an offence.

He appeared in provincial court in custody via teleconference on Jan. 18 after being arrested on a warrant in Fredericton. He was released with conditions but failed to return to court for plea in February. Sarchfield also failed to appear in court to answer charges on Jan. 16, but a warrant was issued.

Johnville man released with ankle bracelet

Ryan Troy O’Donnell, 27, of Johnville, appeared in provincial court in custody by video on June 12 for a bail hearing. After spending several months in custody, he was released with conditions, including wearing an electronic monitoring device attached to his ankle. He will also follow a curfew and reside at a Woodstock residence.

O’Donnell returns to court for a plea on June 26 at 9:30 a.m. on two charges of possession of stolen property (cheques) on Dec. 16, 2023, in Beechwood and mischief causing property damage on Feb. 15. The RCMP laid the charges. The court heard he is also facing other charges in Edmundston and Moncton.

On April 11, he was in custody by video to answer a sex charge laid by RCMP. He pleaded not guilty, and a trial date was set for June 26 at 9:30 a.m. He was charged with sexual assault in connection with an incident in Beechwood between Sept. 1 and Sept. 30, 2021.

O’Donnell appeared in provincial court in custody on Feb. 23 for a bail hearing and waived his bail until later. He was charged by RCMP with breach of a release order on Feb. 15 and held in custody.

He also appeared in provincial court in custody on Jan. 24 for a bail hearing. He was released with conditions, including wearing an electronic monitoring device attached to his ankle, but was brought back into custody.

O’Donnell was charged by RCMP with assault involving a female victim, uttering threats, and breach of probation concerning an incident on Jan. 25 near Johnville.

He has a prior criminal record.

In custody awaiting plea

Nicholas Charles Paul, 46, of Neqotkuk, will appear in provincial court in custody for plea on June 18 at 11 a.m. He appeared in provincial court in custody on June 3 and was denied bail.

He has been in custody since his arrest in early May. He was charged with breaching a release order by failing to follow the conditions of electronic monitoring (ankle bracelet) following an incident on May 1 at Neqotkuk.

Woodstock Police also charged him with possession of a stolen vehicle and breach of probation concerning an incident in Woodstock on June 29, 2023.

Paul was sentenced to 12 months of house arrest after pleading guilty to a series of other charges laid by RCMP. The first six months will be full house arrest followed by six months with a curfew. However, he will not be released to begin his house arrest until the newer charges are resolved.

Paul pleaded guilty to possession of a stolen vehicle, obstructing police, and breach of an undertaking on Dec. 3, 2021, in Grand Falls and Neqotkuk; guilty to possession of a stolen vehicle, breach of probation and possession of a stolen credit card for an incident on Sept. 12, 2023, in Hartland; guilty to theft from a store in Carlingford on Aug. 30, 2023; guilty to two counts of dangerous driving, two counts of suspended driving, and two counts of flight from police for incidents on Aug. 8 and Aug. 11, 2023, in Perth-Andover; and guilty to failing to attend court on Nov. 21, 2023.

He was fined $1,200 for driving while suspended and was prohibited from driving for one year.

Paul was also charged with flight from police, and break, enter and theft at a storage shed following an incident on Sept. 4, 2022, at Perth-Andover. He changed his plea to guilty and is still awaiting sentencing for those offences. Paul had a limited prior criminal record.

Sentencing set for Greenfield man

Terrance Wright, 60, of Greenfield, will appear in provincial court for sentencing on June 20 at 9:30 a.m. after pleading guilty to several charges laid by Woodstock Police and RCMP.

Woodstock Police charged Wright with assaulting another man and uttering threats concerning an incident on Feb. 24 in Woodstock.  He pleaded guilty.

RCMP also charged him with three counts of uttering threats against a female victim, committing mischief causing property damage, and breaching a no-contact order in connection with incidents on Dec. 11 and Dec. 23, 2023, at Greenfield. He was ordered to have no contact with the complainant. He changed his plea to guilty to three of those charges.

Wright appeared in provincial court in custody by video on April 18 for a bail hearing. He was released with conditions, including wearing an electronic monitoring device attached to his ankle.

Sentencing set after change of plea

James Edward Pickard, 30, of Perth-Andover, will appear for sentencing in provincial court on June 21 at 1:30 p.m. after changing his plea to guilty on an assault charge laid by RCMP.

Pickard pleaded guilty to assault with a weapon (a Japanese sword called a katana) concerning an incident on April 29, 2023, at Perth-Andover. The crown withdrew another charge of possession of a weapon dangerous to the public peace.

Pickard agreed to sign a 12-month peace bond regarding two other charges of uttering threats and committing mischief on May 3, 2023, in Perth-Andover. The peace bond will result in those charges being withdrawn.

Pickard appeared in provincial court in custody for his bail hearing on July 12, 2023, and was released with conditions.  He was remanded until his release from custody.

In custody on charges of confinement, assault with torch

Dustin Robert Davenport, 40, of Aroostook, will appear in provincial court in custody by video on June 21 at 1:30 p.m. for monitoring about his trial on multiple charges laid by RCMP.

He pleaded not guilty on all counts, and his trial dates were set for July 8 at 9:30 a.m., Aug. 8-9 at 9:30 a.m. and Aug. 26 at 9:30 a.m.

On May 21, Defence Counsel David Lutz told the court a resolution may be reached with the crown before the trial.

Davenport appeared in provincial court in custody by video on Jan. 4 and was denied bail. He was charged by RCMP with aggravated assault involving a female victim, uttering threats, unlawful confinement, possession of a prohibited weapon (a handheld torch), and breach of probation for an incident on Dec. 12, 2023, near Perth-Andover when a woman was seriously burned.

Davenport was also charged with uttering threats, breach of probation, breaching a no-contact order, assault involving another female victim, and forcible entry at a dwelling house in connection with a separate incident on Sept. 4, 2023, at Carlingford.

He was also charged with dangerous driving for an incident on Oct. 13, 2023, at Perth-Andover when a man was allegedly dragged by a moving vehicle.
