Guns seized during arrest of Neqotkuk man
Stephen Perley, 28, of Neqotkuk (Tobique First Nation), appeared in provincial court in custody by video on Oct. 24 to answer multiple firearm charges laid by RCMP. He was remanded to jail to await a bail hearing on Oct. 28 at 9:30 a.m.
Perley was charged with unlawful transport of firearms (several rifles, a shotgun, and a nine-millimetre handgun), possession of prohibited firearms, two counts of transporting firearms in a careless manner, two counts of possessing firearms without a licence, and possession of a gun with the serial number altered in connection with an incident on Sept. 24 at Neqotkuk. He was also charged with flight from police and breach of probation for a separate incident on Sept. 14.
Fined for impaired driving
Natasha Berube, 41, of Grand Falls, appeared in provincial court in custody on Oct. 25 after failing to appear for trial on an impaired driving charge. She changed her plea to guilty and was fined $1,000. She was also prohibited from driving for one year.
RCMP charged Berube in connection with an incident on Oct. 29, 2023, when police stopped a vehicle travelling in the wrong lane on the Trans Canada Highway around 3:25 a.m.
The court heard Berube was trying to get home to Grand Falls and entered the wrong lane by following incorrect travel information on GPS (Global Positioning System). She had no prior criminal record.
Committed to stand trial
Joseph Michael Sercerchi, 73, of Bayfield, Ontario, appeared in provincial court on Oct. 25 for a preliminary hearing on three sex charges laid by Woodstock Police. He was committed to stand trial and returns on Dec. 2 at 9 a.m. to set a date for his trial by judge alone at the Court of King’s Bench.
Sercerchi was charged with three counts of indictable sexual assault involving a female minor in connection with incidents which occurred between Jan. 1, 1991, and Dec. 31, 1998, in Woodstock.
Woodstock man remanded to await trial
Curtis Brent Hatheway, 43, of Woodstock, appeared in provincial court in custody by video on Oct. 24 after being arrested on a warrant by Woodstock Police.
Hatheway waived his bail until later and was remanded to jail to await his trial on Dec. 5 at 9:30 a.m. He pleaded not guilty to multiple charges, including two counts of breach of probation and two counts of breaching a peace bond between June 30 and July 8 and on Sept. 13 in Woodstock, breach of an undertaking, breach of probation, breach of a peace bond and criminal harassment between Sept. 14 and Sept.16 in Woodstock. The charges relate to a no-contact order involving a female complainant.
Trial adjourned to new date
Timothy Grant Davenport, 46, of no fixed address, appeared for trial in provincial court in custody on Oct. 25 to answer nine charges laid by RCMP. The trial was adjourned to Oct. 30 at 9:30 a.m.
Davenport was charged by RCMP with theft of a gun and ammunition, committing mischief by breaking a window, resisting arrest, possession of a prohibited weapon (a loaded sawed-off shotgun), reckless discharge of a firearm, pointing a gun at another man, possession of a firearm without a licence, possession of ammunition while prohibited, and possession of a firearm while prohibited, in connection with an incident on Nov. 26, 2023, near Lakeville.
He appeared in court for a bail hearing on Nov. 29, 2023, and was remanded to jail. He pleaded not guilty to the charges at a court appearance on Feb. 13. Davenport also awaits sentencing for another offence after pleading guilty to a fraud charge.
Decision reserved after trial
Robert Corey Goodine, 35, of Perth-Andover, appeared in provincial court on Oct. 24 for his trial on charges laid by RCMP. After one day of testimony, Judge Karen Lee reserved her decision until Dec. 5 at 9:30 a.m.
Goodine appeared in provincial court in custody in January for a bail hearing and was released with conditions. He was charged by RCMP with assault with a weapon (a set of keys) involving a female victim between Jan. 1, 2022, and Feb. 28, 2022, at Perth-Andover; and assault by choking between Jan. 1, 2021, and Dec. 31, 2021, at Perth-Andover. He was ordered to have no contact with the complainant.
During the trial, the court heard the case involved an alleged domestic dispute. In closing submissions, Defence Counsel L.A. Henry told the court Goodine denied the assaults and said he was never in an intimate relationship with the complainant.
Newbridge woman released with conditions
Tracy Taylor, 41, of Newbridge, appeared in provincial court in custody by video on Oct. 24 for a bail hearing. She was released with conditions and returns to court for her trial on June 11, 2025, at 9:30 a.m.
Taylor was charged with breaching her release order (curfew) on Sept. 15 at Grafton and breach of a no-contact order on Oct. 21 in Newbridge. She pleaded not guilty on Oct. 24.
She will also stand trial in provincial court on June 11, 2025, at 9:30 a.m. after pleading not guilty to four other charges laid by RCMP.
Taylor appeared in provincial court in custody in April and was released with conditions. She was charged with careless use of a firearm, pointing a gun at another person, possession of a firearm without a licence (a shotgun and rifle) and uttering threats against a male victim in connection with an incident between March 3 and March 31 in Newbridge. She entered her not-guilty plea at a court appearance on June 4.
Sentencing set after guilty plea
Kyrin Moulton, 19, of Grand Falls, formerly of Neqotkuk, appeared in provincial court in custody by video on Oct. 24 for a bail hearing. He was released with conditions and returns to court on Nov. 19 at 1:30 p.m. for sentencing on three charges.
RCMP charged Moulton with assault involving a female victim, breach of probation and possession of stolen prescription medication stemming from an incident on Oct. 22 at Perth-Andover. He pleaded guilty on all three counts. The crown withdrew another charge of breach of probation.
As part of his release, Moulton was ordered to stay away from the Village of Perth-Andover.
Woodstock man awaits sentencing
Myles Andrew Dymond, 49, of Woodstock, appeared in provincial court on Oct. 23 for a hearing about his earlier request in May to retract his guilty pleas.
Defence Counsel James Crocco told the court that Dymond’s guilty pleas on four charges would stand and that his client would proceed to sentencing. Judge Sebastian Michaud set the sentencing date for Nov. 27 at 1:30 p.m.
Dymond was charged by Woodstock Police with breach of a no-contact order and two counts of breaching an emergency intervention order on Aug. 19-21, 2023, and on Sept. 17-18, 2023, in Woodstock. He pleaded guilty.
The crown withdrew another charge of transmitting intimate images without consent.
Dymond first appeared in provincial court in custody on Aug. 28, 2023, and was released with conditions. He was charged with breach of an undertaking by failing to abide by a no-contact order following an incident on Aug. 26, 2023, in Woodstock. He pleaded guilty on Jan. 24.
On Sept. 19, 2023, he faced charges of assault on a female victim on March 26, 2023, at Bedell, and uttering threats on June 18, 2023, in Woodstock. The crown withdrew these charges.
Accused headed to rehab
Robert Lewey of Neqotkuk (Tobique First Nation) appeared in provincial court on Oct. 22 to answer four charges laid by RCMP. The matter was adjourned for plea until Jan. 7, 2025, at 9:30 a.m.
Lewey was charged with theft of a vehicle, impaired driving, dangerous driving and mischief causing property damage in connection with an incident on Aug. 25 at Neqotkuk. The court heard Lewey was scheduled to enter a rehab facility in his community and wanted to delay his plea until after he completed his treatment program.
Sentencing adjourned on assault charges
Matthew McGrath, 30, of Plaster Rock, appeared in provincial court in custody by video for sentencing on Oct. 24 after changing his plea to guilty on charges laid by RCMP. At the crown’s request, his sentencing date was adjourned until Nov. 13 at 1:30 p.m.
McGrath was charged by RCMP with assault involving a female victim, uttering threats, resisting arrest and breach of probation in connection with an incident on June 26-27 at Plaster Rock.
He also pleaded guilty to failing to appear in court in Edmundston on May 28 and mischief causing property damage to the Madawaska jail sprinkler system on May 11. He was denied bail on these charges. The court is waiting for a victim impact statement about damage sustained at the institution.
Following his arrest in June, McGrath was remanded to the Restigouche hospital for a mental health assessment until July 10. He is expected to receive a sentence of time served.
Quebec man still in custody
A Quebec man remains in custody after a spike belt was used to stop a vehicle that was travelling in the wrong lane on the Trans Canada Highway and then fled from police near Woodstock during the early morning hours of Aug. 5.
Frederick Garneau Watson, 42, of Saint Liguori, was arrested by RCMP near Maliseet Fuels at Wotstak (Woodstock First Nation) and remanded to jail.
He appeared in provincial court in custody by video on Oct. 23 to answer charges of dangerous driving, flight from police, assault and obstruction. The matter was adjourned for plea until Oct. 30 at 9:30 a.m. at the request of his defence counsel.
Police laid the charges after receiving a report of a vehicle travelling in the wrong lane on Highway 2 around 1:30 a.m. and then spotted it driving erratically in the parking lot at Maliseet Fuels. The vehicle attempted to flee the scene.
Police deployed a tire deflation device to stop it. The driver exited the vehicle and was arrested at the scene. A loaded handgun was located in the vehicle subsequent to his arrest.
Decision pending in sexual assault case
Maurice Joseph Rossignol, 68, of Woodstock, appeared for trial in provincial court on Oct. 23 after pleading not guilty to sexual assault. Judge Sebastian Michaud reserved his decision after trial until Dec. 5 at 2 p.m.
Woodstock Police charged Rossignol in connection with an incident on Aug. 30, 2023, in Woodstock.
During the trial, the court heard Rossignol allegedly grabbed a woman by the breast and genitals when he came to her apartment to request repayment of a $45 loan. Rossignol denied the allegations and testified he left immediately after she refused to pay him. The woman told the court she screamed when he grabbed her and then kicked him out.
Trial adjourned again
Harlie Dominique Scott, 25, of Fredericton, was scheduled to appear for trial in provincial court on Oct. 25 after pleading not guilty to three charges laid by Woodstock Police. The trial was adjourned until Jan. 24, 2025, at 9:30 a.m. with the consent of both the crown and defence counsel.
Scott was charged with fleeing from police, dangerous driving, and driving while suspended concerning an incident on Feb. 6, 2021, in Woodstock.
Stolen property charge diverted
Sasha Perley, 28, of Grand Falls, appeared for trial in provincial court on Oct. 23 on a stolen property charge laid by RCMP.
Perley was charged with possessing a stolen vehicle (a Toyota Tundra) for an incident on Aug. 4, 2023, near Tobique Narrows. She pleaded not guilty.
On Oct. 23, the charge was moved to the alternative measures program with the consent of the crown. Perley has until Jan. 28, 2025, at 1:30 p.m. to complete the program in order to have the charge withdrawn.
Perley was also charged with possessing a stolen vehicle concerning another incident on July 25, 2023, at Craig’s Flat in Victoria County. That matter was also moved to the alternative measures program with the consent of the crown. She has until Dec. 10 at 1:30 p.m. to complete the requirements of the program in order to have the charge withdrawn.
Two charged in break-in
James Blair Hovey, 27, of Perth Andover, and Justin Ryan Shea, 36, of Woodstock, are facing charges related to a break-in at a residence in Woodstock.
They appeared in provincial court in custody by video on Oct. 3 for their bail hearings. Hovey was released with conditions. On Oct. 24, he pleaded not guilty, and his trial date was set for July 14, 2025, at 9:30 a.m.
Shea was also released with conditions. He appeared in court for plea on Oct. 22 when the matter was adjourned until Nov. 12 at 9:30 a.m.
They were each charged by Woodstock Police with break, enter and theft at a dwelling house on Creighton Street on Sept. 26. Hovey was also charged with breach of probation, while Shea faced an additional charge of breaching an undertaking (curfew).
Shea will also appear in provincial court on Nov. 12 at 9:30 a.m. for plea on two other charges laid by Woodstock Police. He was charged with mischief causing property damage and break, enter, and theft at the East Coast Truck Wash for an incident on March 17 in Lower Woodstock.
Hovey also appeared in provincial court on July 23 and pleaded not guilty to two charges laid by RCMP. His trial date was set for July 14, 2025, at 9:30 a.m.
RCMP charged Hovey with possession of a stolen vehicle and breach of probation stemming from an incident on Jan. 9 at Carlingford. He appeared in provincial court in custody via teleconference on May 21 after being arrested on a warrant for failing to appear in court. He was released with conditions at that time.
Hovey appeared in provincial court on April 30 and pleaded not guilty to other charges laid by RCMP. His trial date was set for May 9, 2025, at 9:30 a.m. RCMP charged him with possession of a stolen ATV, flight from police, and breach of probation concerning an incident on March 30 at Tobique Narrows.
Sentencing delayed for Neqotkuk woman
Tammy Schloemer, 57, of Neqotkuk, appeared for sentencing in provincial court on Oct. 23 after changing her plea to guilty on charges laid by RCMP and Woodstock Police. Her sentencing was adjourned until Jan. 30, 2025, at 1:30 p.m. to allow for the completion of a pre-sentence report.
Schloemer was charged by RCMP with assault while threatening to use a weapon (a wooden stick) against another woman and committing mischief causing property damage to a window in relation to an incident on Oct. 3, 2021, at Neqotkuk. Woodstock Police also charged her with shoplifting at the Superstore on April 20, 2023.
She pleaded guilty to the store theft and the mischief charge. The crown withdrew the assault charge.
Sentencing reset for Armour
Brandon Cecil Armour, 34, of no fixed address, appeared in provincial court in custody by video on Oct. 24 for sentencing after changing his plea to guilty on several charges. The matter was adjourned until Oct. 31 at 11 a.m. since his defence counsel was not present for his sentencing hearing.
Woodstock Police charged Armour with prowling at night and resisting arrest in connection with an incident on March 24, 2023, in Woodstock. He pleaded guilty on May 1.
On Sept. 5, he also pleaded guilty to breach of an undertaking and failing to attend court on July 11, 2023; guilty to theft of a vehicle and resisting arrest on Aug. 14, 2023, in Woodstock; guilty to two counts of breaching a release order by violating electronic monitoring on Jan. 2 in Summerfield and on Feb. 6 in Johnville.
Armour appeared in provincial court in custody by video on April 11 and was sentenced to one year in jail, minus time served, after pleading guilty to another charge. He was also placed on probation for 12 months.
Armour was charged by RCMP with breaking into a dwelling house, committing mischief causing property damage to a door, and assaulting a female victim, stemming from an incident on June 8, 2022, in Beechwood. He pleaded guilty to breaking into the dwelling, and the crown withdrew the two remaining charges.
Neqotkuk couple back in custody
Jennifer Louise Paul, 45, and Nicholas Charles Paul, 46, of Neqotkuk (Tobique First Nation), appeared in provincial court in custody via teleconference on Oct. 24. They were both remanded to jail to await a bail hearing on Oct. 28 at 1:30 p.m.
They were each charged by RCMP with possession of methamphetamine for the purpose of trafficking for an incident on Oct. 23 at Neqotkuk.
Nicholas Paul was also charged with breach of a release order and driving while prohibited on Sept. 22-24 at Neqotkuk, breach of a release order (no drugs), possession of ammunition while prohibited, and possession of a stolen licence plate on Oct. 23 at Neqotkuk.
Jennifer Paul was also charged with breach of a release order (no weapons), possession of a stolen licence plate, and possession of a prohibited weapon (a collapsible baton) without a licence on Oct. 23 at Neqotkuk.
The couple appeared in provincial court in custody on Oct. 16 for a bail hearing and was released with conditions, including wearing electronic monitoring devices attached to their ankles. They were rearrested a week later.
They were each charged with breaching their house arrest concerning an incident on Sept. 26 in the community. A hearing about the breach allegation will be held on Oct. 28 at 1:30 p.m.
Jennifer Paul was sentenced in September to three months of house arrest. She pleaded guilty to possession of a stolen vehicle, obstructing police, and possession of a firearm (a rifle) without a licence for an incident on Dec. 3, 2021, at Neqotkuk.
Nicholas Paul was ready for sentencing on other charges when he was arrested on Oct. 15 along with his wife.
He had already spent several months in custody after pleading guilty to breaching a release order by failing to follow the conditions of electronic monitoring (ankle bracelet) for an incident on May 1 at Neqotkuk, and guilty to possession of a stolen vehicle and breach of probation concerning another incident on June 29, 2023, in Woodstock.
Paul was also sentenced to 12 months of house arrest after pleading guilty to a series of other charges laid by RCMP. His house arrest commenced when he was released from custody.
He has a new sentencing date of Nov. 26 at 1:30 p.m. on three remaining charges of flight from police, and break, enter, and theft at a storage shed following an incident on Sept. 4, 2022, at Perth-Andover. He changed his plea to guilty. Paul had a limited prior criminal record.
