Woodstock Provincial Court: Greenfield man sentenced after changing plea

Sentenced to 429 days or time served

Dustin Arthur Hawksley, 28, of Greenfield, appeared for trial in provincial court on multiple charges on Sept. 16. He changed his plea to guilty on three charges and was sentenced to 429 days in jail or time served.

Hawksley was released from custody after spending months in jail on remand.

The RCMP charged Hawksley with breach of a release order by violating electronic monitoring (ankle bracelet), escaping lawful custody, assaulting a police officer and resisting arrest in connection with an incident on Dec. 6, 2023, at Greenfield.

He changed his plea to guilty on three of the charges while the crown withdrew the assault charge.

Hawksley also pleaded guilty to another charge of failing to report to the national sex offender registry on April 28, 2023.

Woodstock Police also charged him with assaulting a female, assault by choking and breach of an undertaking for another incident on Aug. 5, 2023, in Woodstock. He pleaded not guilty, and his trial began on Sept. 16.

The court heard the details of a domestic dispute at an apartment building in Woodstock.  Hawksley agreed to sign a 12-month peace bond and the trial did not continue. The peace bond will result in the withdrawal of the assault charge.

Hawksley appeared in provincial court in custody for a bail hearing in September and was released with conditions, including wearing an electronic monitoring device attached to his ankle. He was also placed under house arrest at a residence in Greenfield but was brought back into custody in December. On Dec. 20, 2023, he appeared in court in custody for a bail hearing and was remanded to jail.

Awaiting federal time

Felicia J. Fulton, 29, of Woodstock, appeared in provincial court in custody by video on Sept. 17 and requested her charges be transferred to Fredericton. She told the court she will be sentenced on Oct. 26 in Fredericton on 20 charges and expected to receive a federal prison sentence.

Woodstock police charged Fulton with two counts of breach of probation, theft from Canadian Tire, and two violations of the Trespass Act following incidents at the Canadian Tire store in Woodstock between May 22 and May 31.

The RCMP also charged Fulton with theft of groceries from a store in Perth-Andover on June 30.

Fulton was arrested on a warrant related to her charges in Fredericton. A monitoring date was set for Oct. 29 at 9:30 a.m. to confirm her charges in Woodstock have been transferred.

Held for bail hearing

Kayla Dawn Tibbits, 32, of Woodstock, appeared in court in custody via teleconference on Sept. 17 after being arrested on a warrant for failing to appear in court. She was remanded for a bail hearing on Sept. 18 at 1:30 p.m.

Tibbits was charged with two counts of shoplifting at the Atlantic Superstore in Woodstock on Jan. 10, 2023, and on Sept. 6, 2023, and one violation of the Trespass Act. She was offered alternative measures but failed to complete the program. She told the court on Tuesday she intended to plead guilty to the charges and proceed to sentence.

Fined $2,600 for impaired driving

Robert Norman Malouin, 35, of Rhode Island, appeared in provincial court on Sept. 17 and pleaded guilty to impaired driving. He was fined $2,600 and was prohibited from driving for one year.

RCMP charged Malouin in connection with an incident on May 17 near Belleville. The court heard he was arrested at the Woodstock/Houlton border crossing around 10 p.m. while driving a motorcycle. His blood alcohol level was more than double the legal limit. Malouin had no prior criminal record.

Fined $1,950 for impaired driving

Jamie Donald Lessard, 35, of Stickney, appeared in provincial court on Sept. 17 and pleaded guilty to impaired driving. He was fined $1,950 and was prohibited from driving for one year.

Lessard appeared in provincial court on June 15 for a bail hearing and was released with conditions following his arrest. RCMP charged him with two counts of uttering threats, refusing a breathalyzer, impaired driving, and committing mischief causing property damage in connection with incidents on June 2 in Stickney and Glassville. He was also charged with assault for another incident on May 28.

Lessard completed the alternative measures program requirements, and most charges were withdrawn. The breathalyzer charge was also withdrawn on Sept. 17, leaving his guilty plea for impaired driving. The court heard Lessard was found intoxicated and sleeping behind the wheel along the side of the highway in Stickney. He had no prior criminal record.

Pair jointly charged with offence

Avory Saige Vatali, 22, and Alexander Timothy Gordon Jansen, 22, both of Woodstock, will appear in provincial court on Oct. 15 at 9:30 a.m. to answer a charge laid by Woodstock Police.

Vatali and Jansen were jointly charged with failing to provide the necessities of life to another person concerning a recent incident in Woodstock. They made their first court appearance on Sept. 17 when the matter was set over for plea.

Released to await sentencing

Lucas Green, 19, of Woodstock, appeared in provincial court on Sept. 17 for sentencing on two charges laid by RCMP. The matter was adjourned until Oct. 15 at 1:30 p.m. to allow for the completion of a victim impact statement.

Green appeared in provincial court in custody by video on Aug. 22 for a bail hearing. He was released with conditions, including wearing an electronic monitoring device attached to his ankle.

Green was charged with aggravated assault against another man and committing mischief causing property damage to a vehicle in connection with an incident on Oct. 19, 2023, at Richmond Corner. 

He pleaded guilty to the lesser offence of assault causing bodily harm. The crown intends to withdraw the mischief charge at sentencing.

Green also pleaded guilty to uttering threats for another incident on June 15 at Mapledale. The crown withdrew another mischief charge.

Green appeared in provincial court in custody by video on July 2 for a bail hearing and was released with conditions, including wearing an electronic monitoring device attached to his ankle. He was scheduled to return for plea, but was taken back into custody for breaching his release order.

Trial dates set on multiple charges

Clay Nicholson, 27, of Woodstock, formerly of Clearview, appeared in provincial court on Sept. 17 and pleaded not guilty to multiple charges laid by RCMP. His trial date was set for July 3, 2025, at 9:30 a.m.

Nicholson appeared in provincial court in custody on Aug. 26 and was released with conditions, including wearing an electronic monitoring device attached to his ankle.

He was charged with assault with a weapon (a pizza cutter), unlawful entry at a dwelling house, uttering threats, and assaulting another man on May 24 at Florenceville-Bristol.

He was also charged with assaulting a woman and assault by choking on Aug. 15 at Centreville and breach of a no-contact order on Aug. 22 in Centreville. A monitoring date was set for May 24, 2025, at 9:30 a.m.

Agreed to peace bond

Takoda Christian, 18, of Neqotkuk (Tobique First Nation), appeared in provincial court on Sept. 17 to answer an assault charge. He agreed to sign a 12-month peace bond and the charge did not proceed.

The RCMP charged Christian with assault with a weapon (a bow and arrow) in connection with an incident on Feb. 11 at Wotstak (Woodstock First Nation). The peace bond will result in the charge being withdrawn.

In custody awaiting plea

Trevor Gerald McDougall, 32, of Perth-Andover, appeared in provincial court in custody by video on Sept. 17 for plea on charges laid by Woodstock Police. The matter was adjourned until Sept. 24 at 1:30 p.m. at the request of his defence counsel.

McDougall appeared in provincial court in custody by video on Sept. 4 and was denied bail. He was charged with breach of a release order on Aug. 31 in Woodstock, two counts of breaching an emergency intervention order on Aug. 31 and Sept. 1, and breach of a no-contact order on Sept. 1.

Woodstock Police also charged McDougall with assault involving a female victim on July 26 and then uttering threats and assaulting the same woman on Aug. 21 at a residence in Woodstock. He has a dated prior criminal record.

Sentencing set on assault charges

Matthew McGrath, 30, of Plaster Rock, appeared in provincial court in custody by video on Sept. 17 and changed his plea to guilty on charges laid by RCMP. His sentencing date was set for Oct. 15 at 1:30 p.m.

McGrath was charged by RCMP with assault involving a female victim, uttering threats, resisting arrest and breach of probation in connection with an incident on June 26-27 at Plaster Rock.

He also pleaded guilty to failing to appear in court in Edmundston on May 28 and mischief causing property damage to the Madawaska jail sprinkler system on May 11. He was denied bail on these charges.

Following his arrest in June, he was remanded to the Restigouche hospital for a mental health assessment until July 10.

Returning for plea

Mitchell LaFrance of Perth-Andover appeared in provincial court on Sept. 17 to answer an assault charge laid by RCMP. The matter was adjourned for plea until Oct. 8 at 9:30 a.m. at the request of his defence counsel.

LaFrance was charged with assault causing bodily harm involving a female victim stemming from an incident on July 19 at Carlingford.

He also appeared in provincial court in December on several other charges laid by RCMP. He pleaded not guilty, and a trial date was set for Oct. 10 at 9:30 a.m.

RCMP charged him with breaching of an undertaking by failing to comply with a no-contact order in connection with an incident involving a female victim on Oct. 2, 2023, at East Brighton. He was also charged with uttering threats and criminal harassment for incidents between Aug. 28 and Sept. 25, 2023, involving the same complainant.

Glassville man awaiting plea

Adam Luc Joseph Thibodeau of Glassville appeared in provincial court on Sept. 17 for plea on two charges laid by Woodstock Police. The matter was adjourned until Oct. 8 at 9:30 a.m. to allow him more time to secure legal counsel.

Thibodeau was charged with possession of a stolen vehicle and possession of a stolen licence plate in connection with an incident on April 9 in Woodstock. 

Adjourned to new date

Brian Keith Reynolds, 45, of Wotstak (Woodstock First Nation), appeared in provincial court on Sept. 17 to answer several charges laid by RCMP. The matter was adjourned until Oct. 8 at 9:30 a.m. at the request of his defence counsel.

Reynolds appeared in provincial court in custody on July 25 and was released with conditions, including wearing an electronic monitoring device attached to his ankle.

RCMP charged him with uttering threats against a female victim, breach of probation, and driving while suspended, stemming from an incident on Oct. 8, 2023, in Bloomfield. He pleaded not guilty to the charges and returns to court on Oct. 8 to set a trial date.

Reynolds was also charged with two counts of resisting arrest on Nov. 1, 2023, and Nov. 27, 2023, at Wotstak. On Sept. 17, he faced two new charges of assault and assault with a weapon concerning another incident on Aug. 4 at Wotstak. He returns for plea on those charges on Oct. 8.

Trial date confirmed

Joshua Sisson, 37, of Neqotkuk (Tobique First Nation), appeared in provincial court on Sept. 17 for monitoring and confirmed he will be ready to proceed to trial.

Sisson pleaded not guilty to charges laid by RCMP. His trial date was set for March 3, 2025, at 9:30 a.m. He was charged with assault with a weapon (a bottle) involving a female victim, assault, and two counts of uttering threats in connection with an incident on April 8 at Neqotkuk.  He was ordered to have no contact with the complainant.

Plaster Rock woman returning for plea

Makayla Marie Shaw, 26, of Plaster Rock, appeared in provincial court on Sept. 17 to answer three charges laid by RCMP. The matter was adjourned for plea until Sept. 24 at 9:30 a.m. at the request of her defence counsel.

Shaw appeared in provincial court in custody by video on July 15 and was released with conditions. RCMP charged her with causing a disturbance, mischief, and breach of a peace bond for an incident on July 10 at Anderson Road.

Plea date rescheduled

Braxton Denny, 24, of Woodstock, appeared in provincial court on Sept. 17 for plea on charges laid by Woodstock Police. The matter was adjourned until Oct. 8 at 9:30 a.m. at the request of his defence counsel.

Denny appeared in provincial court in custody by video on June 17 for a bail hearing and was released with conditions, including wearing an electronic monitoring device attached to his ankle.

He was charged with assault, committing mischief by damaging a TV, and breach of a release order by failing to abstain from drugs between May 1 and June 6 in Woodstock; and assaulting a woman, assault by choking, two counts of uttering threats, committing mischief by damaging a mirror and a door, and breach of a release order by failing to abstain from drugs for another incident between June 6-7 in Woodstock.

Denny was also charged with possession of stolen property on July 23, 2023; flight from police on July 22, 2023, and two counts of failing to appear in court on Oct. 17 and Oct. 24, 2023. He pleaded not guilty, and a trial date was set for Dec. 11 at 9:30 a.m.

He was also charged with breaking into a dwelling house and committing mischief concerning an incident on Feb. 18, 2023, in Woodstock; committing mischief causing property damage and breach of an undertaking on Dec. 9, 2022, at Upper Woodstock; and two counts of assault and committing mischief causing property damage on Dec. 8, 2022, at Upper Woodstock. His trial was set for Sept. 25 but was adjourned to Oct. 8 at the request of his defence counsel.

Plaster Rock man facing assault charges

Tanner Gridzak, 24, of Plaster Rock, appeared in provincial court on Sept. 17 to answer charges laid by RCMP. The matter was adjourned until Sept. 24 at 9:30 a.m. at the request of his defence counsel.

Gridzak was charged with two counts of assault with a weapon (a knife) involving two different victims and impaired driving in connection with an incident on Nov. 11, 2023, near Arthurette.

Returning for plea

Whitney Leigh McGuire, 42, of Richmond Corner, will appear in provincial court on Oct. 8 at 9:30 a.m. to answer one charge laid by Woodstock Police.

McGuire was charged with criminal harassment through repeated communication with another person between March 4 and March 20 near Woodstock. She appeared in court on Sept. 17 when the matter was adjourned for plea to the new date.

Facing mischief charge

Lisa McGratten, 38, of Perth-Andover, will appear in provincial court on Oct. 8 at 9:30 a.m. to answer a mischief charge.

McGratten was charged by RCMP with mischief causing property damage to a garage door concerning an incident on April 6 near Rowena. She appeared in court on Sept. 17 when the matter was adjourned for plea to the new date.

Neqotkuk man to stand trial

Austin Aube, 28, of Neqotkuk (Tobique First Nation), appeared in provincial court in custody by video on Sept. 17 and pleaded not guilty to several charges laid by RCMP. His trial dates were set for Dec. 9 at 9:30 a.m. and Dec. 13 at 9:30 a.m. He remains in custody.

Aube appeared in court in custody by video on Aug. 29 and waived his bail until later. He was charged with flight from police, two counts of assaulting a police officer with a weapon (an ATV), resisting arrest, dangerous driving, possession of a prohibited weapon (brass knuckles), possession of a prohibited weapon without a licence, and breach of an undertaking on July 28 at Neqotkuk; driving while suspended and flight from police on July 12 at Neqotkuk; assault with a weapon (a knife) involving a female victim, assault by choking, and resisting arrest on May 8 at Neqotkuk. He was arrested on a warrant.

Trial in December for Piercemont man

Caleb Crain, 40, of Piercemont, appeared in provincial court on Sept. 17 for monitoring about his trial in December. He returns to court on Oct. 15 at 9:30 a.m. for confirm he has legal counsel to proceed.

Crain pleaded not guilty to three charges laid by RCMP.  His trial was rescheduled for Dec. 20 at 1:30 p.m. to allow him to secure new legal counsel.

Crain was charged with assault causing bodily harm to a female victim, unlawful confinement, and uttering threats following an incident on Dec. 10, 2022, near Florenceville-Bristol.

Drug trafficking charges withdrawn

The crown withdrew drug trafficking charges laid against Carolann Paul, 27, of Neqotkuk, (Tobique First Nation). She was not in court on Sept. 17 to hear the crown’s decision.

Paul appeared in provincial court on Sept. 15, 2023, for a bail hearing and was released with conditions, including wearing an electronic monitoring device attached to her ankle.

She was charged by RCMP with possession of cocaine and possession of methamphetamine for the purpose of trafficking, stemming from a police bust on Sept. 23, 2020, at Neqotkuk.

She was also charged with possession of methamphetamine for another incident on July 31, 2020, at Neqotkuk. She pleaded not guilty, and her trial dates were set for October.

Woodstock man to stand trial

William Paul McCarron, 51, of Woodstock, will appear for trial in provincial court on Sept. 18 at 1:30 p.m. after pleading not guilty to one charge laid by Woodstock Police.

McCarron was charged with uttering threats against a female victim in connection with an incident on Oct. 26, 2022, near Woodstock.

Trial scheduled on sex charge

Matthew White, 42, of Upper Woodstock, will appear for trial in provincial court on Sept. 18 at 9:30 a.m. on a sex charge laid by RCMP.

White was charged with invitation to sexual touching involving a female minor in connection with an incident on June 3, 2023, in Bloomfield. He pleaded not guilty.
