Woodstock Provincial Court: Man in custody after arrest

Arrested and held in custody

Mitchell McKenzie, 38, of Wotstak (Woodstock First Nation), appeared in provincial in custody on March 7 after being arrested on a warrant. He was remanded to jail to await a bail hearing on March 10 at 1:30 p.m.

RCMP charged McKenzie with assaulting another man with a weapon (a wooden pole) following an incident on July 24, 2024, at Wotstak.  He appeared in provincial court in custody on Nov. 25, 2024, for a bail hearing and was released with conditions, but then failed to return to court for plea on Dec. 17, 2024.

Remanded for bail hearing

William (Billy) Harding, 34, of Plaster Rock, will appear in provincial court in custody by video on March 11 at 1:30 p.m. for a bail hearing.

Harding appeared in provincial court in custody via teleconference on March 6 after being arrested on a warrant.  He appeared in provincial court in custody by video on Feb. 10 and was released with conditions but failed to return to court for plea on March 4.

Harding was charged by Woodstock Police with theft from the Superstore and breach of probation following an incident on Sept. 10, 2024, in Woodstock. He was also charged with theft of a laptop and breach of probation on March 20, 2024, and breach of probation by failing to report between Dec. 12, 2023, and Sept. 3, 2024.

Facing assault charges

Christian Karnes-McQuade, 23, of Richmond Corner, will appear in provincial court on April 1 at 9:30 a.m. to answer five charges laid by Woodstock Police.

Karnes-McQuade was charged with assaulting a female victim, assault while threatening to use a weapon (a pocket knife), assault by choking, uttering threats, and unlawful confinement in connection with an incident between Jan. 28 and Feb. 2 in Woodstock. He made his first court appearance on March 4 and was released on an undertaking.

Gordonsville man has two charges

Clayton Giberson, 64, of Gordonsville, will appear in provincial court on April 1 at 9:30 a.m. for plea on two charges laid by RCMP.

Giberson was charged with assault and mischief causing property damage to a truck for an incident on Nov. 24, 2024, in Gordonsville. He made his first court appearance on March 4, when the matter was adjourned to the new date.

Released on an undertaking

Joshua Hanlon, 30, of Neqotkuk (Tobique First Nation), will appear in provincial court on March 25 at 9:30 a.m. for plea on three counts of assault.

RCMP charged Hanlon with assaulting a female victim on Jan. 1, between Jan. 15-25, and again on Jan. 31 at Neqotkuk. He made his first court appearance on March 4 and was released on an undertaking.

Charged with impaired driving

Andrew Muir Cossio, 22, of Victoria Corner, will appear in provincial court on April 1 at 9:30 a.m. for plea on an impaired driving charge.

Woodstock Police charged Cossio with impaired driving following an incident on Nov. 17, 2024, in Woodstock. He made his first court appearance on March 4, when the matter was adjourned to the new date.

In custody awaiting plea

Jacob Alexander Roy, 27, of Windsor, appeared in provincial court in custody by video on March 6 for a bail hearing.  He waived his bail until later and returns to court in custody for plea on March 13 at 9:30 a.m.

Roy was charged with breaching a release order by violating the conditions of his house arrest (ankle bracelet) following an incident on Feb. 8 at Coldstream. He has been in custody since his arrest.

Roy was also charged by Woodstock Police with possession of methamphetamine and cocaine, both for the purpose of trafficking, breach of a release order, carrying a concealed weapon, and possession of a weapon dangerous to the public peace, concerning an incident in Woodstock on Aug. 3, 2024.

The crown withdrew another charge of possessing a prohibited weapon (brass knuckles).

Neqotkuk man still in custody

Kyrin Moulton, 19, of Neqotkuk (Tobique First Nation), appeared in court in custody by video on March 6 for a bail hearing. He waived his bail until later and returns to court in custody for plea on March 25 at 11 a.m. A new date for his bail hearing may be set at that time.

Moulton was charged by RCMP with aggravated assault involving another man, breaching a release order, and breach of probation for an incident on Nov. 23, 2024, at Perth-Andover. He had a prior criminal record.

On Feb. 18, he appeared in court for sentencing after pleading guilty to other charges laid by the RCMP. He was handed 60 days in jail or time served and 12 months of probation. He was then taken back into custody.

Moulton was charged with assault involving a female victim, breach of probation and possession of stolen prescription medication stemming from an incident on Oct. 22, 2024, in Perth-Andover.

Greenfield man awaiting plea

Jorge Heinz Fenske, 56, of Greenfield, appeared in provincial court in custody by video on March 6 to answer charges laid by RCMP. The matter was adjourned for plea until March 18 at 9:30 a.m.

Fenske was denied bail and remanded to jail on Feb. 27. He was charged with breaching an undertaking (no-contact order) in connection with an incident on Feb. 1 at Greenfield and breach of an undertaking (no-contact order), assault with a weapon, and uttering threats between Feb. 14 and 15 at Greenfield.

He is also scheduled to appear in provincial court on April 1 at 9:30 a.m. to answer multiple other charges laid by the RCMP.

Fenske was charged with assault causing bodily harm involving a female victim, assault with a weapon (a broom), and unlawful confinement for an incident on Nov. 16, 2024, at Wotstak (Woodstock First Nation). He was also charged with assault, causing bodily harm, uttering threats and taking a vehicle without consent following an incident on Dec. 10, 2024, at Wotstak.

On March 6, Defence Counsel Tim Culbert requested a hearing for Fenske on two other firearm charges. The RCMP charged Fenske with possession of a firearm without a licence and improper storage of a firearm stemming from an incident on Dec. 14, 2023, in Greenfield.

Culbert told the court he would be seeking a motion to quash the charges due to an error in the police’s information. A hearing was set for March 27 at 9:30 a.m. Fenske’s trial on the firearm charges, set for March 17, was postponed until after the hearing.

Wotstak man in custody on six charges

Greg Paul McCormick, 36, of Wotstak (Woodstock First Nation), appeared in provincial court in custody by video on March 6 for a bail hearing on six charges laid by Woodstock Police and RCMP. He waived his bail until later and returns to court in custody for plea on March 18 at 11 a.m.

McCormick was charged with possession of a prohibited weapon (a taser) while prohibited from having it and possession of a prohibited weapon without a licence concerning an incident on Feb. 25 in Woodstock.

He was also charged with breach of probation, mischief causing property damage to a truck, and possession of a weapon (a BB gun) to commit an offence on Feb. 25 at Wotstak. Another breach of probation charge was also laid for an incident on Feb. 9 at Wotstak.

On March 6, the court heard McCormick wants to enter a rehab facility if he is granted bail at a later date.

Neqotkuk man waives bail

Brandon Michael Francis, 29, of Neqotkuk (Tobique First Nation), appeared in provincial court in custody by video on March 6 for a bail hearing. He waived his bail until later and returns to court in custody for plea on March 18 at 11 a.m.

Francis appeared in court in custody via teleconference on March 3 after being arrested on a warrant. RCMP charged him with breach of a release order by violating electronic monitoring (ankle bracelet) concerning an incident on Jan. 10 at Neqotkuk.

He was also charged with breach of probation, breach of a no-contact order, and resisting arrest following another incident on Jan. 1-2 at Neqotkuk. He was released from custody with conditions on Jan. 4 and then taken back into custody a few days later for allegedly cutting off his ankle bracelet. Francis has a prior criminal record.

Trial continues in April

Christopher Hazen Hamilton, 50, of Woodstock, will appear in provincial court on April 16 at 9:30 a.m. to continue his trial after pleading not guilty to 12 charges laid by Woodstock Police.

On Jan. 8, Judge Sebastian Michaud heard testimony from police officers and the female victim who described horrific details of domestic violence involving the accused. The trial continued on Feb. 28 and then adjourned until April 16.

Hamilton appeared in custody by video on June 10, 2024, and was released with conditions, including wearing an electronic monitoring device attached to his ankle.

He was charged with assault involving a female victim, assault by choking, three counts of uttering threats, assault with a weapon (a broken teacup) and attempting to cause injury and suffering to a dog, concerning incidents between March 1 and May 24, 2024, in Woodstock.

Hamilton was also charged with assaulting a female victim, uttering threats and mischief causing property damage on May 25, 2024, and assaulting a female victim and assault with a weapon (a cigar) on May 26, 2024. The alleged incidents occurred in Woodstock. He spent several days in remand before his release.

Trial adjourned

Jessica Brewer, 35, of Wakefield, was scheduled to appear for trial in provincial court on March 6 on two assault charges laid by RCMP. At the request of her defence counsel, the trial was adjourned. A new date for her trial will be set for March 18 at 9:30 a.m.

Brewer was charged with assault on a minor and assault with a weapon (plates, spoons and a chair) in connection with an incident between Jan. 1, 2019, and May 20, 2024, in Wakefield. She pleaded not guilty.

Johnville man awaits sentencing

Ryan Troy O’Donnell, 27, of Johnville, will appear in provincial court in custody for sentencing on two charges on March 14 at 1:30 p.m. His sentencing was first set for March 5 but was adjourned to the new date.

O’Donnell was denied bail on Jan. 9. RCMP charged him with possession of stolen property (cheques) in Beechwood on Dec. 16, 2023, and mischief causing property damage on Feb. 15, 2024. He changed his plea to guilty.

O’Donnell pleaded not guilty to sexual assault in connection with an incident in Beechwood between Sept. 1 and Sept. 30, 2021.  He was found not guilty after trial on March 5. O’Donnell has a prior criminal record.

Murder charge in Nova Scotia

A Perth-Andover man is facing a murder charge in Nova Scotia while also awaiting trial on charges in Woodstock.

Patrick James Denny, 29, of Perth Andover, appeared in provincial court in custody by teleconference on March 6. He told the court he was currently serving a federal prison sentence but was also remanded on a murder charge in Nova Scotia.

In Woodstock, Denny was charged by RCMP with reckless discharge of a firearm, being an occupant of a vehicle knowing it carried a gun, possession of a firearm while prohibited, and possession of a firearm without a license concerning an incident on Nov. 15, 2022, in Hartland. He pleaded not guilty, and his trial was set for Nov. 3 and 6 at 9:30 a.m.

On Oct. 21, 2024, Denny was charged by Halifax RCMP with second-degree murder and committing an indignity to human remains in connection with a homicide that occurred in East Preston, Nova Scotia, on Aug. 30, 2022.

The charges were laid in Dartmouth Provincial Court after police responded to a report of a suspicious van parked behind a strip mall in East Preston. Inside the vehicle, RCMP discovered the body of Barry Angus Studley of Middle Sackville. Denny and Studley were known to each other.

In May 2023, Denny was sentenced in Woodstock to a total of three and a half years in federal prison for his involvement in a police chase near Wotstak (Woodstock First Nation) that involved weapons and assaulting a police officer. Denny was on parole when he was arrested. He appeared in court in custody on Nov. 21, 2022, and waived his bail.

Trial on stolen property charge

Carly Muzzerolle, 30, of no fixed address, will appear for trial in provincial court on Feb. 25, 2026, at 9:30 a.m. after pleading not guilty to a stolen property charge laid by RCMP.

Muzzerolle pleaded not guilty at a court appearance on March 4. She made her first court appearance on Feb. 11, when the matter was adjourned to allow her more time to secure legal counsel.
