Woodstock Provincial Court: Man charged with attempted murder

East Brighton man charged, then released with conditions

Ozzie Jr. Trecartin, 30, of East Brighton, was charged with attempted murder when he appeared in provincial court in custody by video on July 30 for a bail hearing.

Trecartin was released from custody with conditions, including wearing an electronic monitoring device attached to his ankle. He was released under a $1,000 bail bond and will reside at a residence in Peel. He was ordered to have no firearms in his possession and no contact with the alleged victim.

Trecartin will return to court for plea on Sept. 10 at 1:30 p.m. RCMP charged him with attempted murder, reckless discharge of a firearm at a place while a person was inside, two counts of indictable assault against another man, uttering threats, resisting arrest, possession of a firearm without a licence, and storage of multiple guns in a careless manner following an incident on July 21 at East Brighton. He was also charged with impaired driving on the same date in Peel.

90 days or time served

Cain Glendon Sparkes, 40, of Richibucto Road, appeared in provincial court in custody by video on July 30 after pleading guilty to two charges laid by RCMP. He was sentenced to 90 days in jail or time served and was placed on 12 months of probation. He must also attend counselling for drug and alcohol addiction.

Sparkes was charged with two counts of being at large on a release order and possession of a stolen vehicle in connection with an incident on May 24 at Lower Knoxford.

He pleaded guilty to having the stolen vehicle and one count of being at large on a release order. The crown will withdraw the remaining charge at sentencing. The court heard the Sparkes was also facing additional charges in Fredericton.

The accused apologized to the court for his actions and told Judge Lucie Mathurin he hoped to return to full-time work and stay sober. He had a limited prior criminal record.

Sentencing adjourned for Cloverdale man

A Cloverdale man was expected to receive a federal prison term this week for shooting at a police officer. His sentencing was adjourned until Sept. 10 at 1:30 p.m. with the consent of both the crown and defence counsel.

Wyatt DeLong, 28, pleaded guilty to discharging a firearm with intent at a police officer, flight from police, dangerous driving, and indictable breach of probation in connection with an incident on July 14, 2023, at Florenceville-Bristol. DeLong has been in custody since his arrest.

Under the Criminal Code of Canada, a conviction for discharging a firearm with intent (to endanger the life or safety of another person) carries a potential prison sentence of five years for a first offence.

A co-accused, Janis Buchanan, 28, of Perth-Andover, appeared in provincial court in custody by video in September 2023 and pleaded guilty to robbery with violence for an incident on May 29, 2023, at Florenceville-Bristol. She was sentenced to two years in federal prison.

RCMP arrested DeLong and Buchanan after a manhunt in Victoria County following a series of incidents in the upper River Valley.

Sentencing postponed

John Long, 34, of Woodstock, was scheduled to appear in provincial court in custody by video for sentencing this week on one charge laid by Woodstock Police. The sentencing was adjourned until Sept. 10 at 1:30 p.m. with the consent of the both the crown and defence counsel.

Long appeared in court on Jan. 12 for a bail hearing and was remanded to jail.

He was charged with two counts of breaching a release order and breach of probation concerning a Jan. 5 incident in Woodstock.

He changed his plea to guilty to one charge of breaching his release order by violating electronic monitoring (ankle bracelet), and the other two charges were withdrawn by the crown.

Fined $1,950 for impaired driving

David Joseph Deacon, 47, of Belleville, Ontario, was fined $1,950 when he appeared in provincial court on July 30 and pleaded guilty to impaired driving. He was also prohibited from driving for one year.

Woodstock Police charged Deacon in connection with an incident on Main Street in Woodstock during the early morning hours of June 23. The court heard he was working in the area as a construction manager for repairs to the Florenceville-Bristol bridge. He had a dated record from 1989 for one conviction of impaired driving.

Bail hearing delayed

Brandon Michael Francis, 28, of Neqotkuk (Tobique First Nation), appeared in provincial court in custody by video on July 26 for a bail hearing. The hearing was adjourned until Aug. 13 at 11 a.m. He remains in custody.

RCMP charged Francis with four counts of committing mischief causing property damage, breach of probation, assault involving a female victim, uttering threats, and willfully causing injury to a dog by kicking it. The charges were laid in connection with July 17 and July 19 incidents at Neqotkuk. He has a prior criminal record.

Sentencing rescheduled for Bloomfield man

Logan Sanders, 25, of Bloomfield, appeared in provincial court in custody for sentencing on July 30 after pleading guilty to several charges laid against him by RCMP.  The sentencing was adjourned until Sept. 4 at 1:30 p.m. to allow for the submission of victim impact statements.

Sanders pleaded guilty to indictable dangerous driving and failing to stop at the scene of an accident concerning an incident on April 26 near Meductic. He was arrested while attempting to cross the Woodstock/Houlton border.

The charges were laid following an accident when an oncoming car driving in the wrong lane forced a vehicle off the four-lane highway. A Plaster Rock woman and three youths were not injured when their vehicle left the highway and rolled over in the ditch after swerving to avoid the oncoming car.

Sanders also pleaded guilty to committing mischief by damaging a woodstove, walls, door and a table at a residence on Dec. 1-31, 2023, in Bloomfield; guilty to two counts of uttering threats on Sept. 1 in Bloomfield; and guilty to mischief by damaging doors and windows on Oct. 1-31, 2023, in Maple Ridge.

He pleaded not guilty to another charge of assault with a weapon (a knife) involving a male victim on Sept. 1, 2023, in Bloomfield. His trial date was set for Sept. 4 at 1:30 p.m. Sanders was denied bail on May 30.

Johnville man awaiting trial

Jeffrey David Watson, 33, of Johnville, appeared in provincial court on July 30 and pleaded not guilty to three firearm charges laid by RCMP. His trial date was set for July 2, 2025, at 9:30 a.m.

Watson was charged with possession of a firearm without a licence, possession of a firearm dangerous to the public peace, and careless use of a firearm in relation to an incident on Nov. 27, 2023, at Lower Kintore. A monitoring date for his trial was also scheduled for Jan. 28, 2025, at 9:30 a.m. to confirm he has legal counsel to proceed.

Trial adjourned on firearm charge

Jerry Inman, 68, of Kincardine, was scheduled to appear for trial in provincial court on July 31 after pleading not guilty to a firearm charge laid by RCMP. The court heard he was dealing with serious health issues, so the matter was adjourned to Sept. 3 at 9:30 a.m. to set a new trial date.

Inman was charged with intentionally discharging a firearm into or at a place knowing another person was present there in connection with an incident on April 27, 2023, in Kincardine. He entered his not-guilty plea at a court appearance on Oct. 3, 2023.

Neqotkuk man to enter plea

Joshua Sisson, 37, of Neqotkuk (Tobique First Nation), will appear in provincial court on Aug. 20 at 9:30 a.m. for plea on charges laid by RCMP.

Sisson was charged with assault with a weapon (a bottle) involving a female victim, assault, and two counts of uttering threats in connection with an incident on April 8 at Neqotkuk.

He appeared in court on July 30 when the matter was adjourned to allow him more time to secure legal counsel. Sisson was ordered to have no contact with the complainant.

Trial set for Clearview man

Kyle Laurie Williams, 35, of Clearview, appeared in provincial court on July 30 for monitoring about his trial. He told the court he was still trying to hire a lawyer. Another monitoring date was set for Aug. 27 at 9:30 a.m.

Williams is scheduled to appear for trial in provincial court on Oct. 7 at 9:30 a.m. after pleading not guilty to one charge laid by RCMP. He was charged with transmitting intimate images without consent concerning an incident on June 4, 2023, at Centreville. Williams entered his not-guilty plea during a court appearance on Jan. 9.

Charged with assaulting police

Bronson Paul of Neqotkuk (Tobique First Nation) will appear in provincial court on Aug. 20 at 9:30 a.m. for plea on two charges laid by RCMP.

Paul was charged with assaulting police and resisting arrest in connection with an incident on May 10 at Neqotkuk. He appeared in court on July 30 when the matter was adjourned to the new date to allow him more time to secure legal counsel.

Facing threat charge

Jacob Jinson, 25, of Woodstock, will appear in provincial court on Aug. 6 at 9:30 a.m. to answer a threat charge. He appeared in court on July 30 for plea when the matter was adjourned to allow him more time to secure legal counsel.

Jinson appeared in provincial court in custody on April 17 and was released with conditions. RCMP charged him with uttering threats for an incident on April 10 at Somerville.

Arthurette man to enter plea

Nicholas William Sutthery, 40, of Arthurette, will appear in provincial court for plea on Aug. 20 at 9:30 a.m. on a charge of having stolen property.

Sutthery was charged by RCMP with possession of a stolen truck in connection with an incident between Jan. 1 and 11 at Carlingford. He appeared in court on July 30 when the matter was adjourned to allow him more time to secure legal counsel.

Sentencing reset on three charges

Nicholas Charles Paul, 46, of Neqotkuk (Tobique First Nation), appeared in provincial court in custody by video for sentencing on July 30 after pleading guilty to three charges laid by RCMP. His sentencing was rescheduled for Aug. 13 at 1:30 p.m. to allow for the submission of a victim impact statement.

Paul was denied bail on June 3. He has been in custody since his arrest in early May. He pleaded guilty to breaching a release order by failing to follow the conditions of electronic monitoring (ankle bracelet) for an incident on May 1 at Neqotkuk and guilty to possession of a stolen vehicle and breach of probation concerning another incident on June 29, 2023, in Woodstock.

Paul was sentenced to 12 months of house arrest after pleading guilty to a series of other charges laid by RCMP. The first six months will be full house arrest followed by six months with a curfew. However, he will not be released to begin his house arrest until the newer charges are resolved.

Paul pleaded guilty to possession of a stolen vehicle, obstructing police, and breach of an undertaking on Dec. 3, 2021, in Grand Falls and Neqotkuk; guilty to

possession of a stolen vehicle, breach of probation and possession of a stolen credit card for an incident on Sept. 12, 2023, in Hartland; guilty to theft from a store in Carlingford on Aug. 30, 2023; guilty to two counts of dangerous driving, two counts of suspended driving, and two counts of flight from police for incidents on Aug. 8 and Aug. 11, 2023, in Perth Andover; and guilty to failing to attend court on Nov. 21, 2023.

He was fined $1,200 for driving while suspended and was prohibited from driving for one year.

Paul was also charged with flight from police, and break, enter, and theft at a storage shed following an incident on Sept. 4, 2022, at Perth-Andover. He changed his plea to guilty and is awaiting sentencing for those offences. Paul had a limited prior criminal record.

Plymouth Road man has another trial

Andrew Pelkey, 44, of Plymouth Road, appeared in provincial court on July 30 and pleaded not guilty to breaching his release order. His trial date was set for Aug. 6 at 9:30 a.m. when he is scheduled to be in court for monitoring on other separate charges.

Pelkey appeared in provincial court in custody for a bail hearing on Feb. 5 and was released with conditions. A warrant was issued after he failed to appear in court for plea on Dec. 19, 2023. He was also charged with breaching his release order by violating his curfew following an incident in Woodstock on Sept. 30, 2023.

Pelkey is facing eight other charges for an earlier incident. He pleaded not guilty to assault with a weapon (a belt, glass bottle and stick), assault by choking, uttering threats, assault, pointing a firearm at another person, possession of a weapon dangerous to the public peace (BB guns and a pellet gun), careless use of a firearm, and willfully causing pain to a dog by shooting it with a pellet gun. The alleged threats and assaults involve a female victim in connection with incidents which occurred between Feb. 1 and March 21, 2023, near Richmond Corner.

The trial on those matters was adjourned to Aug. 28 at 9:30 a.m., and a monitoring date was set for Aug. 6 at 9:30 a.m. Associate Chief Judge Brian C. McLean told Pelkey there would be no further adjournments and the trial would proceed in August.
