RCMP officer scheduled for plea
Corporal Andrew Whiteway, a member of the Woodstock RCMP, will appear in provincial court on Nov. 13 at 9:30 a.m. for plea on an assault charge.
Whiteway was charged with aggravated assault for allegedly striking a woman in the face during an arrest in Richmond Corner on June 13. Police were called to a family disturbance in Richmond Corner when a female individual suffered serious injuries during the altercation.
The alleged assault was investigated by the Serious Incident Response Team (SIRT), which is responsible for investigating matters involving police officers.
Whiteway has been temporarily reassigned to administrative duties as a result of the investigation. He was scheduled to appear in court on Oct. 2, but the matter was adjourned to the new date at the request of his Defence Counsel, T.J. Burke.
Sentencing set for transmitting nude photos
Michael Anthony Allain, 52, of no fixed address (Alberta), will appear for sentencing in provincial court on Nov. 13 at 1:30 p.m. after changing his plea to guilty on an indictable charge of knowingly transmitting intimate images without consent. He changed his plea to guilty on summary conviction.
Allain was charged by Woodstock Police in connection with incidents involving a female victim between April 3 and April 7, 2023, in Woodstock and Fredericton.
The court heard Allain shared several nude images and one sexually explicit image of the victim with a group of individuals online and also posted a number of “vile” messages about her on Facebook.
The court heard the photos were taken with the woman’s consent, but she did not give permission for the accused to share them with others. Allain told police he regretted his actions and eventually deleted many of the images which he shared in an act of revenge over the end of a relationship.
In preparation for sentencing, the crown requested victim impact statements from the woman and the individuals who received the images from Allain. Defence Counsel Patrick Hurley represented the accused.
Plea pending for Limestone man
Riley Cowper, 20, of Limestone, will appear in provincial court in custody by video on Nov. 13 at 11 a.m. for plea on an attempted murder charge following an alleged violent attack on another local man.
RCMP charged Cowper with attempted murder by using a hammer and a wrench to assault Rodney Butler, mischief causing property damage to a car window, uttering threats, and robbery of a vehicle in connection with an incident on Aug. 10 at Jackson Falls.
He was arrested on Aug. 13 and ordered to have no contact with Butler, who police said was treated at hospital for injuries and later released. On Oct. 18, Cowper waived his bail until later.
Cowper is also facing a separate charge of assault with a weapon (a hammer and tire iron) involving another man on March 23, 2022. That trial was adjourned to Dec. 16 at 9:30 a.m.
Sentencing set Neqotkuk woman
Jerrica Bear of Neqotkuk (Tobique First Nation) will appear for sentencing in provincial court on Feb. 11, 2025, at 1:30 p.m. after pleading guilty to a forgery charge laid by RCMP.
Bear pleaded guilty to uttering a forged document (three cheques valued at approximately $1,000) between June 23 and July 2, 2022, at Neqotkuk. The crown withdrew a second charge of fraud. Bear was arrested on a warrant in September for failing to appear in court and was released with conditions.
Remanded for bail hearing
Joshua Sisson, 37, of Neqotkuk (Tobique First Nation), appeared in provincial court in custody via teleconference on Nov. 12 and was remanded to jail. He returns to court in custody by video for a bail hearing on Nov. 14 at 9:30 a.m.
RCMP charged Sisson with two counts of uttering threats for an incident on Nov. 11 at Neqotkuk. He was also charged with flight from police on Sept. 24.
He is also awaiting trial on other separate charges on March 3, 2025, at 9:30 a.m. Sisson pleaded not guilty to assault with a weapon (a bottle) involving a female victim, assault, and two counts of uttering threats in connection with an incident on April 8 at Neqotkuk. He was ordered to have no contact with the complainant.
Released with ankle bracelet
Jordan Ronald Broad, 29, of Florenceville-Bristol, appeared in provincial court in custody by video for a bail hearing on Nov. 12 after being arrested on the weekend. He was released with conditions, including wearing an electronic monitoring device attached to his ankle. He returns to court for plea on Dec. 3 at 9:30 a.m.
RCMP charged Broad with breach of probation and breach of an undertaking. He was ordered to have no firearms in his possession as part of his release and must not have any contact with the female complainant.
Arrested on the weekend
Benjamin Bolster, 19, of Perth-Andover, appeared in provincial court in custody by video on Nov. 12 for a bail hearing on an arson charge. He was released with conditions and returns to court for plea on Dec. 3 at 9:30 a.m.
RCMP charged Bolster in connection with a fire in Perth-Andover. He was arrested on a warrant for failing to appear in court.
Additional charge for Neqotkuk man
Stephen Perley, 28, of Neqotkuk (Tobique First Nation), appeared in provincial court in custody by video on Nov. 12 to answer an additional charge laid by RCMP.
He was charged with resisting arrest for an incident on Sept. 10 at Neqotkuk. The matter was adjourned for plea until his next court date on Nov. 28.
Perley also appeared in provincial court in custody by video on Nov. 4 for a bail hearing on multiple firearm charges laid by RCMP. He was denied bail and returns to court in custody for plea on Nov. 28 at 9:30 a.m.
Perley was charged with unlawful transport of firearms (several rifles, a shotgun, and a nine-millimetre handgun), possession of prohibited firearms, two counts of transporting firearms in a careless manner, two counts of possessing firearms without a licence, and possession of a firearm with the serial number altered in connection with an incident on Sept. 24 at Neqotkuk. He was also charged with flight from police and breach of probation for a separate incident on Sept. 14.
Sentencing delayed on sex charge
A River de Chute man, facing jail on a sex charge, appeared in provincial court on Nov. 12 for a hearing about withdrawing his guilty plea.
Martin Sargefield, 30, was charged by RCMP with touching a female minor for a sexual purpose (indictable) between July 1, 2016, and July 22, 2022. He pleaded guilty, and the evidence against him was read into the record by the crown. The court heard about a series of sexual acts involving Sargefield and the victim.
Sargefield was not prepared to present legal arguments on Tuesday and did not have a lawyer to assist him. Judge Pierre Gionet adjourned the hearing until Dec. 10 at 1:30 p.m.
At that time, Sargefield must prove he was unaware of the allegations and charges, that he was unaware of the effect and consequences of his guilty plea, that his plea was not made voluntarily, and that his plea was equivocal in nature.
Two other sex charges, which were to be withdrawn by the crown at sentencing, will remain before the court as a result of Sargefield’s request to take back his guilty plea.
Trial set on weapons charges
Ryan Fitzherbert, 29, of Woodstock, will appear for trial in provincial court on Sept. 22, 2025, at 9:30 a.m. after pleading not guilty to weapons charges. His trial was set at a court appearance on Nov. 12.
Fitzherbert was charged by RCMP with improper storage of a firearm, possession of a firearm without a licence, and possession of a prohibited weapon (a switchblade knife) in connection with an incident on Dec. 10, 2021, in Jacksonville.
Alleged invasion of privacy
Dale Boyle, 70, of no fixed address, will appear in provincial court on Nov. 26 at 9:30 a.m. to answer one charge laid by RCMP.
Boyle was charged with making a visual recording of another person without their consent when there was a reasonable expectation for privacy for an incident between Feb. 1 and Aug. 10 at Plaster Rock. He made his first court appearance on Nov. 12 and was released on an undertaking.
Senior returning for plea
Arthur Thibodeau of Lower Brighton will appear in provincial court on Dec. 3 at 9:30 a.m. for plea on two charges laid by RCMP.
Thibodeau was charged with uttering threats and assault with a golf club concerning an incident on July 21 at Lower Brighton. He appeared in court on Nov. 12 when the matter was adjourned to the new date. The court heard the defence will be seeking a resolution with the crown.
Wilmot man facing three charges
Ronald DeLong, 38, of Wilmot, will appear in provincial court on Dec. 3 at 9:30 a.m. to answer three charges laid by RCMP.
DeLong was charged with two counts of possession of a stolen motorcycle and possession of ammunition while prohibited following an incident on Aug. 7 at Wilmot. He appeared in court on Nov. 12 when the matter was adjourned to the new date at the request of his defence counsel.
Charged with assault
Tristan Alexander Calhoun, 38, of Woodstock, will appear in provincial court on Dec. 10 at 9:30 a.m. for plea on an assault charge.
Calhoun was charged by Woodstock Police with assaulting a woman, stemming from an incident between March 31 and Oct. 30 in Woodstock. He made his first court appearance on Nov. 12 when the matter was adjourned to the new date at the request of his defence counsel.
Lakeville man to enter plea
Gregory Kelly, 52, of Lakeville, will appear in provincial court on Nov. 26 at 9:30 a.m. to answer one charge laid by RCMP.
Kelly was charged with possession of a stolen vehicle in relation to an incident on Aug. 4 at Lakeville. He made his first court appearance on Nov. 12 when the matter was adjourned to the new date at the request of his defence counsel.
Plea adjourned on two charges
Dynielle Allison Demerchant, 28, of Woodstock, appeared in provincial court on Nov. 12 to answer two charges laid by Woodstock Police. The matter was adjourned for plea until Nov. 26 at 9:30 a.m.
Demerchant was also charged with identity theft (cards) and possession of methamphetamine concerning an incident on May 2 in Woodstock. She appeared in provincial court in custody on Nov. 4 and was released with conditions.
Demerchant was also charged by Woodstock Police with possession of methamphetamine for the purpose of trafficking and possession of a prohibited weapon (a switchblade) in connection with an incident on Dec. 22, 2022, in Woodstock. She entered her not-guilty plea at a court appearance on March 12.
On Nov. 1, her defence counsel told the court a resolution was pending on the trial matter but Demerchant did not appear to deal with the charges and a warrant was issued.
Gordonsville man in custody
Brandon Levesque, 26, of Gordonsville, appeared in provincial court in custody by video on Nov. 12 for a bail hearing. He waived his bail until later and returns to court in custody for plea on Dec. 3 at 9:30 a.m.
Levesque was arrested in October and released with conditions, including house arrest and wearing an electronic monitoring device attached to his ankle. He was brought back into custody on the weekend.
He appeared in provincial court on Nov. 5 for plea on other charges laid by RCMP. Those matters were also adjourned until Dec. 3 at 9:30 a.m.
Levesque was charged by RCMP with breaching his release order (curfew), assault involving a female victim, assault by choking and assaulting a police officer in connection with an incident on Oct. 11 in Gordonsville.
RCMP also charged him with breaking into a dwelling house and mischief causing property damage to a door on July 30 in Plaster Rock and assault with a weapon (a rock) involving a female victim on July 28 in Plaster Rock.
Plea pending for Aroostook man
Marc Morin, 24, of Aroostook, appeared in provincial court on Nov. 12 for plea on charges laid by RCMP. The matter was adjourned until Nov. 21 at 9:30 a.m. at the request of his defence counsel.
Morin appeared in provincial court in custody by video on Oct. 3 for a bail hearing and was released with conditions. He was arrested on a warrant on Oct. 1 for failing to appear in court.
He was charged by RCMP with possession of a stolen snowmobile and obstructing a police officer in connection with an incident on March 6, 2023, in Carlingford. He pleaded not guilty, and his trial date was set. On Oct. 1, he was also charged with breaching a release order by failing to appear for trial on July 15.
Returning for plea
Riley Patrick Michaud, 21, of Woodstock, was scheduled to appear in provincial court on Nov. 12 for plea on charges laid by Woodstock Police. The matter was adjourned until Nov. 26 at 9:30 a.m. at the request of his defence counsel.
Michaud appeared in provincial court in custody on Oct. 8 for a bail hearing and was released with conditions. He was charged with breaching a no-contact order involving a female complainant following an incident on Oct. 2 in Woodstock.
He was also charged with assault involving a female victim in connection with another incident on Aug. 21 in Woodstock.
Trial set on threat charge
Steven Derek Trecartin, 46, of East Brighton, appeared in provincial court on Nov. 12 for monitoring and confirmed he has legal counsel to proceed to trial.
Trecartin will appear for trial in provincial court on May 28, 2025, at 9:30 a.m. after pleading not guilty to a threat charge. Woodstock Police charged him with uttering threats against a female victim following an incident on Nov. 1, 2023, in Woodstock.
Newburg man awaiting plea
Jeffrey Richard Bull, 45, of Newburg, appeared in provincial court on Nov. 12 for plea on two charges laid by Woodstock Police. The matter was adjourned until Nov. 26 at 9:30 a.m. at the request of his defence counsel.
Bull appeared in provincial court in custody by video on Sept. 9 for a bail hearing and was released with conditions. He was charged with aggravated assault and breach of probation concerning an incident on Sept. 8 at 2 a.m. when a man suffered a broken elbow after being struck by a bat on St. James Street in Woodstock. The alleged victim was a newcomer to the town for only three days.
Bull was ordered to reside at a residence in Newburg. He must have no contact with the complainant, stay away from St. James Street, and have no weapons in his possession.
Plea delayed on trafficking charges
Justin Ryan Shea, 36, of Woodstock, appeared in provincial court on Nov. 12 to answer two drug trafficking charges. The matter was adjourned until Nov. 19 at 9:30 a.m. to allow him more time to secure legal counsel.
Shea appeared in provincial court in custody by video on Nov. 7 for a bail hearing and was released with conditions. H also returns to court for plea on Nov. 19 on other separate charges.
He was charged by Woodstock Police with break, enter and theft at a dwelling house on Creighton Street on Sept. 26 and an additional charge of breaching an undertaking (curfew).
Shea was also charged with mischief causing property damage and break, enter and theft at the East Coast Truck Wash for an incident on March 17 in Lower Woodstock.
Sentencing set for Powers
Steven Frank Powers, 60, of Plaster Rock, appeared in provincial court in custody by video on Nov. 12 and pleaded guilty to one charge laid by RCMP. His sentencing was set for Dec. 10 at 11 a.m.
Powers appeared in provincial court in custody by video on Nov. 1 and waived his bail until later. He pleaded guilty to breach of probation in connection with an incident on Oct. 30 in Plaster Rock. He was ordered to have no contact with the female complainant.
Facing fraud charge
Anita Albert, 51, of Plaster Rock, appeared in provincial court on Nov. 12 for plea on a fraud charge. The matter was adjourned until Nov. 26 at 9:30 a.m. at the request of her defence counsel.
RCMP charged Albert with defrauding the Timbertown Lounge during an incident on Sept. 11, 2022, in Plaster Rock.
Awaiting trial dates
Mitchell Hillman, 36, of Wilmot, appeared in provincial court in custody on Nov. 12 to answer charges laid by Woodstock Police. He pleaded not guilty to two charges and returns to court on Nov. 26 at 9:30 a.m. to set a trial date.
Hillman was charged with assault involving a female victim and uttering threats concerning an incident on Sept. 16 in Woodstock. He appeared in court in custody and was released with conditions. On Tuesday, he entered his not-guilty plea.
He was also charged with driving while prohibited on Feb. 12 in Woodstock and mischief causing property damage to a truck on Feb. 16 in Woodstock. He will enter a plea on those charges on Nov. 26.
Hillman also appeared in provincial court on July 23 and pleaded not guilty to a charge related to a break-in at the tourist bureau at Richmond Corner. His trial date was set for June 26, 2025, at 9:30 a.m.
Michael Holt, 68, of Riverglade, also appeared in provincial court on July 23 to answer a charge stemming from the same break-in. He pleaded not guilty and his trial date was set for July 16, 2025, at 1:30 p.m.
The pair was charged by RCMP with break, enter and theft in connection with an incident on Feb. 19.
Adjourned to new date
Brian Keith Reynolds, 45, of Wotstak (Woodstock First Nation), appeared in provincial court on Nov. 12 to answer several charges laid by RCMP. The matter was adjourned until Nov. 21 at 9:30 a.m. at the request of his defence counsel.
RCMP charged him with uttering threats against a female victim, breach of probation, and driving while suspended, stemming from an incident on Oct. 8, 2023, in Bloomfield. He pleaded not guilty and returns to court on Nov. 21 to set a trial date.
Reynolds was also charged with two counts of resisting arrest on Nov. 1, 2023, and Nov. 27, 2023, at Wotstak. On Sept. 17, he faced two new charges of assault and assault with a weapon concerning another incident on Aug. 4 at Wotstak. He returns for plea on those charges on Nov. 21.
Reynolds appeared in provincial court in custody in July and was released with conditions, including wearing an electronic monitoring device attached to his ankle.
Verdict pending on sex charge
Matthew White, 42, of Upper Woodstock, will appear in provincial court on Nov. 13 at 9:30 a.m. for a verdict following his trial on a sex charge laid by RCMP.
White was charged with invitation to sexual touching involving a female minor in connection with an incident on June 3, 2023, in Bloomfield. He pleaded not guilty, and the trial concluded in October.
Plea adjourned again
Ryan James Dunford, 43, of London, Ontario, appeared in provincial court via teleconference on Nov. 12 to answer one charge laid by Woodstock Police. The matter was adjourned for plea until Dec. 24 at 9:30 a.m.
Dunford was charged with mischief causing property damage to a vehicle on June 21 in Woodstock. He was released on an undertaking and entered a rehab facility in Ontario.
