72 days or time served on three charges
Douglas Thomas Defazio, 35, of Woodstock, appeared in provincial court in custody on May 21 and was sentenced to 72 days in jail or time served.
Defazio was released from custody and placed on probation for 12 months. He was also ordered to register with the federal DNA database and must seek counselling for drug addiction.
Defazio was arrested on the walking trail in Woodstock on April 23 and charged with unlawful entry into a dwelling house and two counts of breaching a release order. The crown withdrew those charges after the accused pleaded guilty to three other charges related to an earlier incident.
Defazio was charged by Woodstock Police with two counts of assault on a female victim, uttering threats, assault with a weapon (chunks of ice), and breach of a peace bond concerning incidents on March 30 and April 1 in Woodstock.
He pleaded guilty to uttering threats, assault with a weapon, and breach of the peace bond. The crown withdrew the two remaining assault charges.
Arrested for alleged theft of mail
William Jarred O’Donnell, 28, of Grafton, appeared in provincial court in custody on May 22 and was remanded to jail. He returns to court for a bail hearing on May 27 at 1:30 p.m.
Woodstock Police charged O’Donnell with mail theft in an incident on May 21. The court heard that more charges are pending.
60 days in jail or time served
Darren Richard Hamilton, 43, of Woodstock, appeared in court in custody by video on May 21 after being arrested on a warrant for failing to appear in court for sentencing in April.
He was handed 60 days in jail or time served on two charges. He was released from custody and told to go to a farm in Greenfield, where a job awaited him.
Woodstock Police charged Hamilton with breaking into a dwelling house to commit mischief in Woodstock on Aug. 5-6, 2023. He pleaded guilty and waived his bail.
The court heard he broke into a home on Upper Main Street in Woodstock after leaving the local Legion in an intoxicated condition. He spent the night on the premises but did not take anything from the residence. The owners were away for the weekend. Hamilton was ordered to stay away from that property as part of his release.
Hamilton also pleaded guilty to breaching a release order by failing to appear in court on Feb. 20. He received a suspended sentence and 12 months of probation for the offence. Hamilton was also ordered to register with the federal DNA database and seek counselling for alcohol addiction. He was prohibited from using firearms for 10 years. One other breach charge was withdrawn.
On April 3, the court heard Hamilton had been homeless for some time. He spent 42 days in custody before his release to await sentencing. He was ordered to return to court on April 30, or another arrest warrant would be issued.
Neqotkuk man handed 120 days in jail or time served
Calvin Joseph Nicholas, 53, of Neqotkuk, appeared in provincial court in custody on May 22 for sentencing on several charges laid by RCMP. He was given 120 days in jail or time served and released from custody.
Nicholas changed his plea to guilty to a charge of breaching an undertaking (no contact order) for an incident at Neqotkuk on Dec. 16, 2021. The court heard he drove by a residence on an ATV and yelled and screamed at another man in the community. The crown withdrew another charge of uttering threats against the same person.
He also pleaded guilty to failing to report to the national sex offender registry on July 3, 2022; guilty to breach of probation between June 27 and Feb. 23, 2023; and guilty to breach of a release order (curfew) between Jan. 1-25 in Lower Kintore. The crown withdrew another breach charge.
Nicholas was arrested on a warrant in March after he failed to appear in provincial court for plea on Feb. 27. He waived his bail. He also appeared in provincial court in custody for a bail hearing on Jan. 31. He was released with conditions, including wearing an electronic monitoring device attached to his ankle, but returned to custody. Nicholas has a lengthy prior criminal record.
Held for bail hearing
Kyrin Moulton, 18, of Grand Falls, formerly of Neqotkuk, appeared in court in custody on May 21 and was remanded to jail. He returns to court in custody for a bail hearing on May 23 at 1:30 p.m.
Moulton wept openly as Judge Natalie H. LeBlanc read the charges against him, telling her he did not want to go to jail.
RCMP charged Moulton with assault involving a female victim, breach of probation, and breach of a release order stemming from an incident between April 14 and April 25 in Perth-Andover.
As sheriffs escorted him from the courtroom, he tried to escape custody on his way back to the cells. Moulton spent a few days in jail in April on other unrelated charges.
Sentencing set after change of plea
James Edward Pickard, 30, of Perth-Andover, appeared in provincial court on May 21 and changed his plea to guilty on an assault charge laid by RCMP. He returns to court for sentencing on June 21 at 1:30 p.m.
Pickard pleaded guilty to assault with a weapon (a Japanese sword called a katana) concerning an incident on April 29, 2023, at Perth-Andover. The crown withdrew another charge of possessing a weapon dangerous to the public peace.
Pickard agreed to sign a 12-month peace bond regarding two other charges of uttering threats and committing mischief on May 3, 2023, in Perth-Andover. The peace bond will result in those charges being withdrawn.
Pickard appeared in provincial court in custody for his bail hearing on July 12, 2023, and was released with conditions. He was remanded until his release from custody.
Bail hearing adjourned
Zachary Sarchfield of Hartland appeared in provincial court in custody by video on May 21 for a bail hearing after being arrested on a warrant. His bail hearing was adjourned until May 30 at 1:30 p.m.
RCMP charged Sarchfield with two counts of unlawful confinement, assault, and possession of a weapon to commit an offence.
He appeared in provincial court in custody via teleconference on Jan. 18 after being arrested on a warrant in Fredericton. He was released with conditions but failed to return to court for plea in February. Sarchfield also failed to appear in court to answer charges on Jan. 16, and a warrant was issued.
Perth-Andover man arrested on a warrant
James Blair Hovey, 27, of Perth Andover, appeared in provincial court in custody via teleconference on May 21 after being arrested on a warrant for failing to appear in court. He was released with conditions and returns to court for plea on two new charges on May 28 at 9:30 a.m.
Hovey was charged by the RCMP with possession of a stolen vehicle and breach of probation following an incident on Jan. 9 at Carlingford.
He appeared in provincial court on April 30 and pleaded not guilty to other charges laid by the RCMP. His trial date was set for May 9, 2025, at 9:30 a.m. The RCMP charged him with possession of a stolen ATV, flight from police, and breach of probation concerning an incident on March 30 at Tobique Narrows.
Hovey appeared in provincial court in custody by video on April 2 and was released with conditions, including a curfew, but failed to return to court on May 7.
Fined $1,950 on impaired driving charge
Kailen Bowmaster, 25, of Woodstock, appeared in provincial court on May 21 and pleaded guilty to an impaired driving charge. He was fined $1,950 and was prohibited from driving for one year.
Woodstock Police charged Bowmaster concerning an incident on Jan. 27 in Woodstock. The incident occurred near the local Legion, where a fight had occurred.
Woodstock man awaits sentencing
Julian Cassius Atherton, 18, of Woodstock, appeared in provincial court on May 22 and changed his plea to guilty on several charges laid by Woodstock Police. His sentencing date was set for Aug. 30 at 9:30 a.m.
Atherton pleaded guilty to three counts of mischief causing property damage to Cook’s Construction on Dec. 18, 2023; the Knights of Columbus Hall on Dec. 19, 2023, and another Woodstock building between Jan. 26 and Jan. 29. He also pleaded guilty to two counts of breaching a release order on Dec. 30, 2023, and Jan. 29 in Woodstock. The crown withdrew several other charges.
Atherton was also charged with possession of methamphetamine for the purpose of trafficking and possession of a weapon dangerous to the public peace (knives). He pleaded guilty to the lesser included offence of indictable possession of methamphetamine and guilty to possessing the knives.
Those charges were laid following an incident on Jan. 29 at 4:30 a.m. when Woodstock Police observed an adult male and a young offender prowling in dark clothing. The two were arrested, and a quantity of crystal meth, meth pills and several knives were seized. Police believed one of the individuals was linked to a series of property crimes and graffiti incidents in the town.
On April 2, Atherton was released from custody with conditions, including full detention at a rehab facility near Moncton. He returned to rehab following his court appearance on May 22.
Trial date set for Woodstock woman
Olivia Annette Young, 31, of Woodstock, appeared in provincial court on May 21 and pleaded not guilty to one charge laid by Woodstock Police. Her trial date was set for June 5, 2025, at 1:30 p.m.
Young appeared in provincial court in custody on April 25. She was released with conditions. She was charged by Woodstock Police with breach of a release order on April 24 in Woodstock. A monitoring date was set for March 11 at 9:30 a.m.
More charges for Richmond Corner woman
Crystal Lee Phillips, 44, of Richmond Corner, appeared in provincial court on May 21 to answer two new charges laid by RCMP. She returns to court for plea on June 11 at 9:30 a.m.
Phillips was charged with flight from police and dangerous driving following an incident on Feb. 24 at Jacksonville. Woodstock Police also charged her with driving while suspended on Feb. 6, fraudulent impersonation, using a credit card knowing it was obtained by fraudulent means, and defrauding the Walmart in Woodstock between Aug. 10, 2019, and June 23, 2023.
She appeared in provincial court in custody on April 18 on another charge of breaching her curfew laid by Woodstock Police. She was released with conditions and will enter a plea at her next court appearance.
Phillips appeared in provincial court in custody by video on April 2 on three other charges laid by Woodstock Police. She was released with conditions at that time, including a curfew. She was charged with possession of methamphetamine, breaking into a dwelling house on March 31 in Woodstock, and flight from police on Feb. 6.
She is also scheduled for trial on Jan. 16, 2025, at 9:30 a.m. in relation to other separate charges. She appeared in court on Feb. 20 to get a new trial date after coming to court in January unprepared for her trial.
Phillips was charged by Woodstock Police with possession of stolen property (a Sobeys gift card) in connection with an incident on May 30, 2022, in Woodstock.
Newbridge woman awaiting plea
Tracy Taylor, 41, of Newbridge, appeared in provincial court on May 21 for plea on four charges laid by RCMP. The matter was adjourned until June 4 at 9:30 a.m. to allow her more time to consult legal counsel.
Taylor appeared in provincial court in custody on April 2 and was released with conditions. She was charged with careless use of a firearm, pointing a firearm at another person, possession of a firearm without a licence (a shotgun and rifle) and uttering threats against a male victim in connection with an incident between March 3 and March 31 in Newbridge.
Released to rehab facility
Megan Elizabeth Lewis, 30, of no fixed address, appeared in provincial court in custody by video on May 21 for a bail hearing on six charges laid by Woodstock Police. She was released with conditions to a rehab facility in Shediac, where she will follow a curfew.
Lewis appeared in provincial court in custody by video on Jan. 23 and pleaded not guilty. She returns to court for her trial on June 12 at 9:30 a.m.
Lewis was charged with unlawful entry at a dwelling house, assaulting another woman, committing mischief causing property damage to a door, two counts of assaulting a police officer, and breach of probation for an incident on Dec. 28 in Woodstock.
New charges for Jacksontown woman
Bonnie Noel, 55, of Jacksontown, appeared in provincial court on May 21 to answer four new charges laid by RCMP. She returns to court for plea on June 11 at 9:30 a.m.
Noel was charged with breach of an undertaking (no contact) on Feb. 18 at Canterbury, breach of an undertaking (no contact) and breach of curfew on April 1 at North Lake, and breach of an undertaking (no contact) on Jan. 21 at North Lake.
She appeared in provincial court on March 12 and pleaded not guilty to two other charges laid by the RCMP. Her trial date was set for Oct. 28 at 1:30 p.m., and a monitoring date was also scheduled for July 9 at 9:30 a.m.
Noel was charged with assault on a male victim and resisting arrest, stemming from an incident on Jan. 19 near North Lake.
Returning for plea
Shawn Sullivan, 38, of Perth-Andover, appeared in provincial court on May 21 for plea on two charges laid by RCMP. The matter was adjourned until June 11 at 9:30 a.m. to allow him more time to consult legal counsel.
RCMP charged Sullivan with breaching a peace bond and uttering threats concerning an incident on April 27 at Gladwyn.
He appeared in provincial court in custody by video on May 9 for a bail hearing and was released with conditions including wearing an electronic monitoring device attached to his ankle. He is residing at a homeless shelter in Fredericton.
Sullivan will also appear for trial in provincial court on Aug. 22-23 at 9:30 a.m. RCMP charged him with uttering threats, assault and assault by choking involving a female victim in connection with incidents between July 14 and Aug. 20, 2023, near Perth-Andover. He pleaded not guilty.
Trial adjourned on two charges
Vanessa Golz, 35, of Woodstock, appeared in provincial court on May 22 to request an adjournment on her trial on two charges laid by Woodstock Police. Judge Sebastian Michaud rescheduled her trial for Nov. 14 at 9:30 a.m.
Golz was charged by Woodstock Police with impaired driving and dangerous driving following an incident on Jan. 2, 2023, in Woodstock. She pleaded not guilty, and a trial date was set for May 24. Her defence counsel told the court the adjournment was needed because Golz must deal with immigration concerns before her trial.
Hearing adjourned one week
Myles Andrew Dymond, 49, of Woodstock, appeared in provincial court on May 22 for a hearing about his request to retract his guilty pleas and go to trial. The matter was adjourned until May 29 at 9:30 a.m. to allow his new Defence Counsel, James Crocco, to be present in court.
Dymond appeared for sentencing in provincial court on May 2 after pleading guilty to several charges laid by Woodstock Police. He informed the court he wanted to retract his guilty pleas and go to trial.
At that time, Judge Sebastian Michaud reminded Dymond that the facts of the case had been read into the record after his guilty pleas had been entered, solidifying the crown evidence against him.
The judge said a hearing would be held to decide whether or not his guilty pleas would be upheld or a trial date set.
Dymond was charged with breach of a no-contact order and breach of an emergency intervention order for an incident on Sept. 17-18, 2023, in Woodstock. On Dec. 5, 2023, he also faced a new charge of transmitting intimate images without consent. He pleaded guilty to these charges on Jan. 24.
Dymond first appeared in provincial court in custody on Aug. 28, 2023, and was released with conditions. He was charged with breach of an undertaking by failing to abide by a no-contact order following an incident on Aug. 26, 2023, in Woodstock. He pleaded guilty on Jan. 24.
On Sept. 19, 2023, he faced charges of assault on a female victim on March 26, 2023, at Bedell and uttering threats on June 18, 2023, in Woodstock. These charges were to be withdrawn by the crown at sentencing. However, the court heard the crown intended to proceed with these charges should the matter go to trial.
Charge withdrawn for Rowan
The crown withdrew a stolen property charge laid against Aaron Rowan, 47, of Bulls Creek, when he appeared for trial in provincial court on May 22.
Rowan was charged by Woodstock Police with possession of stolen property over $5,000 (a tractor owned by Green Diamond Equipment), stemming from an incident on Dec. 17, 2021, in Woodstock. He pleaded not guilty.
The crown could not proceed to trial on May 22 because a key witness was not in court.
Directed not-guilty verdict
Teisha Rose Scott, 24, of Medford, appeared for trial in provincial court on May 22 after pleading not guilty to one charge laid by RCMP. The crown called no evidence and Scott received a directed verdict of not guilty.
RCMP charged Scott with possession of stolen property (a 2006 Suzuki Aerio) following an incident on Oct. 13, 2021, at Neqotkuk (Tobique First Nation). She entered her not-guilty plea at a court appearance on Oct. 10, 2023.
In custody on multiple charges
Kyle Lucas Stairs, 25, of Temperance Vale, appeared in provincial court in custody by video on May 21 to answer two new charges laid by RCMP. He returns to court in custody for plea on June 11 at 9:30 a.m.
Stairs was charged with possessing a stolen vehicle and theft of fuel concerning an incident on April 5 at Perth-Andover. He also has several other charges before the court.
Stairs appeared in court in custody by video on April 11 and was remanded. The RCMP charged him with possession of methamphetamine, possession of a stolen vehicle, possession of a prohibited weapon (brass knuckles), possession of a weapon while prohibited from having it, resisting arrest, mischief causing property damage to a police vehicle, and breach of probation concerning an incident on April 8 in Nackawic.
Woodstock Police also charged him with flight from police, dangerous driving, driving while suspended, and breach of probation for an incident on April 8 in Woodstock. He also faces an additional charge of failing to report to probation between Dec. 5 and Dec. 8, 2023, in Woodstock.
Returning for plea in August
Jordan Little, 41, of East Brighton Road, appeared in provincial court on May 21 for plea on a charge of breaching his release order (curfew). The matter was adjourned until Aug. 29, when he will appear in court on other charges.
RCMP charged Little with breaching his curfew concerning an incident on April 9. He appeared in court in custody on April 10 and was released with conditions.
Little will also stand trial on Aug. 29 at 1:30 p.m. on a charge of possession of a stolen vehicle.
He pleaded guilty to breach of an undertaking on Oct. 4, 2023, in East Brighton and will be sentenced for that offence when he appears for trial on Aug. 29.
Awaiting bail hearing
Jordan Perley, 35, of Neqotkuk, was arrested on new charges and will appear in court in custody on May 23 at 1:30 p.m. for a bail hearing.
He appeared in court in custody on May 8 and was released with conditions after being arrested on a warrant for failing to appear in court in April.
Perley was charged by RCMP with two counts of attempted break and enter at a dwelling house, and two counts of mischief causing property damage on Jan. 1 at Neqotkuk; attempted break and enter at a dwelling house, mischief, possession of a prohibited weapon (a butterfly knife), and possession of a weapon dangerous to the public peace on March 18 at Neqotkuk.
Grand Falls pair to stand trial
Sasha Perley, 28, and Michael Langlois-Martell, 33, both of Grand Falls, appeared in provincial court via teleconference on May 21 for monitoring about their trial on charges laid by RCMP. The matter was adjourned for further monitoring on July 2 at 9:30 a.m. to confirm they have secured legal counsel.
Perley was charged with possessing a stolen vehicle (a Toyota Tundra) for an incident on Aug. 4, 2023, near Tobique Narrows. Her trial date was set for Oct. 23 at 1:30 p.m. She pleaded not guilty at a court appearance on Jan. 23.
Langlois-Martell was charged with possession of a stolen vehicle (a Toyota Tundra), possession of a firearm without a licence (a pump-action shotgun), storage of a firearm in a careless manner, and possession of a weapon dangerous to the public peace regarding the same incident. His trial date was set for Oct. 11 at 1:30 p.m. He also pleaded not guilty on Jan. 23.
Sentencing set for accused in custody
John Long, 34, of Woodstock, appeared in provincial court in custody by video on May 21 and changed his plea to guilty on one charge laid by Woodstock Police.
Long was charged with breaching his release order by violating electronic monitoring (ankle bracelet) on Jan. 5 in Woodstock. He returns to court in custody for sentencing on June 24 at 1:30 p.m.
Long appeared in court on Jan. 12 for a bail hearing and was remanded to jail.
He was charged with two counts of breaching a release order and breach of probation concerning a Jan. 5 incident in Woodstock. The crown will withdraw these two remaining charges at sentencing. The court heard Long is serving a jail sentence on other matters in Saint John.
Beechwood man awaiting trial
Nathan Vallee, 24, of Beechwood, appeared in provincial court on May 21 for monitoring about his trial. He told the court he has legal counsel to proceed.
Vallee pleaded not guilty in February to two charges laid by RCMP. His trial date was set for Jan. 6, 2025, at 1:30 p.m.
Vallee was charged with assault involving a female victim and uttering threats in connection with an incident on Dec. 28, 2023, near Beechwood.
Woodstock man to stand trial
Corey Andrew Lane, 39, of Woodstock, appeared in provincial court on May 21 and pleaded not guilty to all charges laid by RCMP. His trial date was set for June 9, 2025, at 9:30 a.m.
Lane was charged with assault involving a female victim on Jan. 1 at Newbridge and breach of a no-contact order on Feb. 7 at Newbridge. He was also charged with failing to appear in court on March 5 and 14, breaching an undertaking by violating a no-contact order on Feb. 7 at Newbridge and breaching a release order on April 23 at Woodstock. He was ordered to have no contact with the complainant.
Lane appeared in provincial court in custody on March 28 and was released with conditions. He was arrested on a warrant for failing to appear.
Trial date set for Johnston
Travis Wade Johnston, 38, of Woodstock, will appear for trial on May 8, 2025, at 9:30 a.m. after pleading not guilty to two charges laid by Woodstock Police.
Johnston was charged with two counts of breaching a no-contact order for alleged incidents on March 25 and April 2 in Woodstock. He entered his not-guilty plea through his lawyer on May 21.
He also appeared in provincial court on April 16 and pleaded not guilty to several charges laid by Woodstock Police. His trial was set for May 5, 2025, at 9:30 a.m.
Police charged Johnston with two counts of uttering threats, assault involving a female victim, unlawful confinement, committing mischief by removing data from a cell phone, and criminal harassment concerning a series of incidents that took place in Woodstock between Sept. 1-30, 2023, on Feb. 17 and Jan. 31, and between Aug. 1, 2023, and March 12.
Johnston appeared in provincial court in custody on March 20 and was remanded for a bail hearing. Woodstock Police arrested him two days after his first release from custody.
He appeared in court in custody on March 18 and was released with conditions, including a no-contact order. He was back in custody on March 20 for breaching the order and was remanded for a bail hearing on March 21. He was rereleased with amended conditions.
Still in custody on charges of confinement, assault with torch
Dustin Robert Davenport, 40, of Aroostook, will appear in provincial court in custody by video on June 21 at 1:30 p.m. for monitoring about his trial on multiple charges laid by RCMP.
He pleaded not guilty on all counts, and his trial dates were set for July 8 at 9:30 a.m., Aug. 8-9 at 9:30 a.m. and Aug. 26 at 9:30 a.m.
On May 21, Defence Counsel David Lutz told the court a resolution may be reached with the crown before the trial.
Davenport appeared in provincial court in custody by video on Jan. 4 and was denied bail. He was charged by RCMP with aggravated assault involving a female victim, uttering threats, unlawful confinement, possession of a prohibited weapon (a handheld torch), and breach of probation for an incident on Dec. 12, 2023, near Perth Andover when a woman was seriously burned.
Davenport was also charged with uttering threats, breach of probation, breaching a no-contact order, assault involving another female victim, and forcible entry at a dwelling house in connection with a separate incident on Sept. 4, 2023, at Carlingford.
He was also charged with dangerous driving for an incident on Oct. 13, 2023, at Perth-Andover when a man was allegedly dragged by a moving vehicle.
